I recently spoke to Angie regarding the above matter that was assigned docket number 07090013 Z and
pertained to a rezone for a property located at 410 First Ave. NE. Based on my conversation with Angie, Mr.
Euler is formally withdrawing the rezone application before the Plan Commission based an this message.
We will now be filing for a use variance before the BZA. We believe the use variance will better limit the scope
of how Mr. Euler can use the site for a low impact professional office type of use. I will be filing the use variance
application by Friday, November 2nd.

Dear Mr. Euler:
The following letter represents comments for this project specifically addressing the area
of alternative transportation. I have reviewed the revised drawings submitted on October
17,2007 and offer the following comments:
ALTERNATIVE TRANSPORTATION REVIEW COMMENTS
1) The City ofemel Parking Ordinance requires that all commercial and retail
venues include bicycle parking. Bicycle parking spaces are required at a rate of
five (5) bicycle parking spaces per one hundred (l00) automobile parking spaces
with a minimum of four (4) spaces. Please revise your plans to show the required
bicycle parking spaces on your site. Please see the City of Carmel's Parking
Ordinance in order to determine appropriate locations, specifications and
construction details for the above.
2) The Altemative Transportation Plan requires the construction of a 5' sidewalk
along 4th 81. Please revise the plans to include and label this path.
We request that all responses to our comments be provided in writing. Failure to provide
written responses may result in delay ofthe review process.
It is critical that this office be made aware of all modification made on the plans being re-
submitted, particularly ifany such changes are considered "new" or fall outside of our
previous reviews. Please provide revised plans indicating all revisions. Please notify us
of any changes and specifically state any changes, including changes resulting from Plan
Commission, Special Studies or other committee meetings.

Technical Advisory Committee members,
Please find attached the plans and review material for your review at the next TAC meeting. I have been working
with Angie Conn and she has helped guide me through the process so far. I am seeking to rezone the property
from R-3 to 8-5. I do not plan to change the iayout of the building or the property itself, this is why my submission
does not have much detail. I truly believe the property should maintain its residential look while still being able to
be used as an office.
Angie indicated that an e-mail with the attached submission will suffice, but if hard copies are required, I can
certainly mail or hand deliver these documents.

Proposed Land Use
I believe the change in use for this property will be compliant with the Carmel/Clay Comprehensive
Plan. The intended use of the property will be for professional otTice space. DECA Environmental is
a consulting company for manufacturers that specialize in helping companies stay in compliance
with the environmental regulations. The employees predominantly go to the locations with very few
clients visiting the office. For this reason we do not see the need for a store front or to change the
setting of this property to anything other than a residential looking building. I wantto keep the
property exactly the same as it is now.
The hours of operation will be from approximately 7am - Spm, Monday ~ Friday. I do not foresee
the building being able to accommodate more than 6 employees at any given time.
Site Plan
Please see the attached overview from the City of Carmel website. I have attached the building
layout and the 2006 Color Ortho for the property. The parking for the facility currently has a total of
4 spaces available along with street parking.
If the rezone is approved by the Plan Commission & City Council, then the T AC will see this item
come through again as a DP / ADLS application for review of any exterior building and site changes,
such as landscaping, signage, lighting, parking, etc.

Hi Angie,
My name is Diane Hall and Jim Euler has asked me to help him with the paperwork to rezone his property at 410 1 sl Ave.
N.E.
We were looking at the paperwork and we think 8-5 is perfect for what he wants.
The property is presently R-3 and he w()uld like to get it rezoned for an office for his environmental consulting business
but would like the flexibility to be able to sell it someday and still remain residential.
Let me know if I should come in and meet with you to go over the paperwork.
We have a couple questions on the rezone application:
Proposed zoning change: From the

district. I don't know what to put in the blanks.
Statement of compliance with the Carmel/Clay Comprehensive Plan.

Jim wants to keep the property as is, looking residential - no signs.
He is interested in cleaning up the garage, redo the roof (presently galvanized), add a man door to the alley, plumbing and
maybe remodeling someday for offices. We will probably need permits for these remodels.
