ORDINANCE D-1975-07
WHEREAS, Carmel City Court is required to provide an interpreter for criminal defendants who do
not fluently speak-English; and
WHEREAS, there are costs associated with providing such interpreting services; and
WHEREAS, Carmel City Court can re-coup some of these costs from defendants who utilize the
services of a court-appointed interpreter; and
WHEREAS; there exists no specific City repository for funds received from such defendants; and
WHEREAS, it is necessary to establish a "Non-Reverting City Court interpreter fiutd" to accept such
monies and to disburse them to pay for such interpreting services; and
WHEREAS,.the citizens of Carmel will benefit from the creation and operation of such a fund.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1: The foregoing Recitals are fully incorporated herein by this reference.
Section 2: Thai Chapter 2, Article 4, of the Carmel City Code is hereby amended to add a new
Section 130 which shall read as follows:
"Sect. 2.130. Non-Reverting City Court Interpreter Fund.
(a) There is established anon-reverting City Court interpreter fund (the "Non-Reverting City Court Interpreter
Fund") to be used exclusively for the purpose of accepting and disbursing monies received from parties in City
Court who use the services of a Court-appointed interpreter. The City Court Judge shall specify the fee
amount, which shall be applied consistently to parties requiring an interpreter.

(b) The Non-Reverting City Court Interpreter Fund shall be administered and maintained as set forth herein:
The monies contained in the Non-Reverting City Court Interpreter Fund shall be received and
deposited therein from the City Court, in accordance with applicable law.
2. The funds contained in the Non-Reverting City Court Interpreter Fund shall be accounted for and
maintained separate and apart from all other City funds, and shall be invested, with the interest
earned thereon deposited into the Non-Reverting City Court Interpreter Fund.
3. The funds held and accounted for in the Non-Reverting City Court Interpreter Fund shall be
withdrawn only:
a. At the discretion of the City Court Judge;
b. For the purpose of paying for interpreter services and costs associated therewith.
4. All property acquired from monies held in the Non-Reverting City Court Interpreter Fund shall be
titled in the name of the Carmel City Court.
5. The life of the Non-Reverting City Court Interpreter Fund shall be perpetual, unless terminated by
subsequent ordinance."
Section 3. That the remaining provisions of Carmel City Code Chapter 2, Article 4, are not
affected by this Ordinance and remain in full force and effect.
Section 4. This fund shall be identified as Fund 503.
Section 5. If any portion of this Ordinance is for any reason declared to be unconstitutional or
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as
enforcement of same can be given the same effect.
Section.6. This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor and such publication as is required by law.
