HomeMy WebLinkAboutCRC-2-2003/City Center Redevelopment Area RESOLUTION NO. ,A-o9003 RESOLUTION OF THE CITY OF CARMEL REDEVELOPMENT COMMISSION APPROVING AN AMENDMENT TO THE AMENDED REDEVELOPMENT PLAN FOR THE CITY CENTER REDEVELOPMENT AREA WHEREAS, the City of-Carmel Redevelopment Commission (the "Commission"), as the governing body for the City of Carmel Redevelopment Department (the "Department"), pursuant to Indiana Code 36-7-14, as amended (the "Act"), has previously designated an area known as the City Center Redevelopment Area (the "Redevelopment Area"), as a .redevelopment area pursuant to Sections 15 and 16 of the Act, and has approved an Integrated Economic Development Plan & Amended Redevelopment Plan which applies to the Redevelopment Area (the "Plan"); and WHEREAS, pursuant to Section 17.5 of the Act, the Commission to desires to amend the Plan by expanding the existing Redevelopment Area to include the area, described in Exhibit A attached hereto, adding certain parcels to the Commission's acquisition list under the Plan, and making certain findings of fact in connection therewith (the "Amendments"); and WHEREAS, the Amendments are fully set forth in the amendments to the Plan presented at this meeting, and WHEREAS, pursuant to Sections 17.5(a) and 17.5(e) of the Act, the Commission caused to be published and mailed a Notice of Public Hearing with respect to such proposed Amendments; and WHEREAS, at the hearing (the "Public Hearing") held by the Commission on the 13th day of August, 2003, at 7:00 p.m., in the offices of the City Hall Caucus Rooms, located at Once Civic Square, Carmel, Indiana, the Commission heard all persons interested in the proceedings and considered any written remonstrances that were filed and all evidence presented; and WHEREAS, the Commission desires to take final action approving the Amendments. NOW, THEREFORE, BE IT RESOLVED by the City of Carmel Redevelopment Commission, as the governing body of the City of Carmel Redevelopment Department, as follows: 1. After considering the evidence presented at the Public Hearing, the Commission hereby finds and determines that the Amendments are reasonable and appropriate when considered in relation to the Plan and the purposes of the Act, and that the Plan, with the Amendments, conforms to the comprehensive plan for the City of Carmel.. 2. The Commission hereby adopts, ratifies and confirms all of the findings of fact set forth in the amendments to the Plan presented at this meeting. 3. The Amendments are hereby approved in all respects. The Plan, as amended by Amendments, is hereby confirmed in all respects. 4. Any member of the Commission is hereby authorized to take such actions as are necessary to implement the purposes of this resolution, and any such action taken prior to the date hereof is hereby ratified and approved. 5. The Secretary of the Commission is directed to record this final action taken by the Commission pursuant to the requirements of Section 17.5 (g) of the Act. Adopted this 13`h day of August, 2003. CITY OF CARMEL REDEVELOPMENT COMMISSION President Sacrrtarv EXHIBIT A Legal Description of the Amendment to the City Center Redevelopment Area Adding Parcels to the Redevelopment Area The following describes an area to be added to the City Center Redevelopment Area, inclusive of all parcels contained within the boundaries designated, as follows; Beginning at the point of intersection of the west right of way line of Rangeline Road with the south right of way line of Mohawk Drive (a.k.a. City Center Drive), which is within the designated boundaries of the City Center Redevelopment Area, then proceeding northward along the west right of way line of Rangeline Road, to the point of intersection with the south right of way line of 3.d Street SW, then proceeding westward, along the south right of way line of 3 d Street SW, to the point of intersection with the east right of way line of I" Avenue SW, then proceeding northward, along the east right of way line of 1" Avenue SW, to the point of intersection with the southwest comer of parcel 16-09-25-16-03-001-000; then proceeding eastward, along the south property line of parcels 16-09-25-16-03-001-000 and 16-09-25-16-03-002-000, to the southwest comer of parcel 16-09-25-16-03-003-000, then proceeding northward, along the west boundary of parcel 16-09-25-16-03-003-000, to the point of intersection with the south right of way line of 1" Street SW, then proceeding eastward, along the south right of way line of 1st Street SW,.to the point of intersection with the west right of way line of Rangeline Road, then proceeding northward, along the west right of way line of Rangeline Road to the point of intersection with the south right of way line of Main Street, then proceeding northward, across the right of way of Main Street to the north right of way line of Main Street,, then proceeding eastward, along the north right of way line of Main Street, to the point of intersection with the east right of way line of Ist Avenue SE, then proceeding southward, along the east right of way line of I" Avenue SE, to the point of intersection with the north right of way line of Ist Street SE, then proceeding westward, along the north right of way line of I" Street SE, to the southeast corner of parcel number 16-10-30-03-01-030-000, then proceeding northward, along the eastern boundary of parcel numbers 16-10-30-03-01-030- 000 and 16-10-30-03-01-031-000, to the northeast comer of parcel number 16-10-30-03-01-031- 000, then proceeding westward, along the northern boundary of parcel 16-10-30-03-01-031-000, to the point of intersection with the east right of way line of Rangeline Road, then proceeding southward, along the east right of way line of Rangeline Road, to a point directly eastward of the south right of way line of Civic Square Drive, then proceeding westward, across the right of way of Rangeline-Road, to the point of intersection with the south right of way line of Civic Square Drive and the west right of way line of Rangeline Road, which is within the designated boundaries of the City Center Redevelopment Area.
