RESOLUTION OF THE CITY OF.CARMEL
REDEVELOPMENT COMMISSION AMENDING THE
BOUNDARIES OF AN ECONOMIC DEVELOPMENT AREA IN
CITY OF CARMEL AND APPROVING AN AMENDMENT TO THE
ECONOMIC DEVELOPMENT PLAN FOR SAID AREA
WHEREAS, the City of Carmel Redevelopment Commission (the "Commission'), as the
governing body for the City of Carmel Redevelopment Department (the "Department"),- pursuant
to Indiana Code 36-7-14, as amended (the "Act), adopted a Declaratory Resolution on February
28, 2002 (as confirmed by the Commission, the "2002 Resolution"), designating an,area known
as the North Illinois Street Economic Development Area (the "Original Area"), as an economic
development area pursuant to IC 36-7-14-41;
WHEREAS, the 2002 Resolution approved an economic development plan for the
Original Area designated as the North I1linois?Street Economic Development Plan (the "Original
Plan");
WHEREAS, the Commission has thoroughly studied that area of City of Carmel, Indiana
(the "City"), as described in the C-210 Amendment (as hereinafter defined) (such area other than
the Original Area, the "New Area");
WHEREAS, pursuant to IC 36-7-14-17.5, the Commission desires to amend the 2002
Resolution and the Original Plan to expand the boundaries of the Original Area to include the
New Area;
WHEREAS, the addition of the New Area expands the Original Area by more than
twenty percent (20%);
WHEREAS, there has been presented to this meeting for consideration and approval of
the Commission an amendment to the Original Plan entitled "C-210 Amendment to the North
11linois Street Economic Development Area" (the "C-210 Amendment");
WHEREAS, the Commission has caused to be prepared the materials and information
required under Section 15(a) of the Act;
WHEREAS, Sections 41 and 43 of the Act permit the creation of "economic
development areas" and provide that all of the rights, powers, privileges and immunities that may
be exercised by this Commission in a redevelopment area or urban renewal area may be
exercised in an economic development area, subject to the conditions set forth in the Act; and
WHEREAS, the Commission deems it advisable to apply the provisions of said Sections
41 and 43 of the Act to the C-210 Amendment and financing of the C-210 Amendment.
NOW, THEREFORE, BE IT RESOLVED by the City of Carmel Redevelopment
Commission, as the governing body of the City of Cannel Redevelopment Department, as
follows:
1. The C-210 Amendment for the New Area promotes significant opportunities for
the gainful employment of the citizens of the City, attracts major new business enterprises to the
City, retains or expands significant business enterprises existing in the City, and meets other
purposes of Sections 2.5, 41 and 43 of the Act, including without limitation benefiting public
health, safety and welfare, increasing the economic well being of the City and the State of
Indiana (the "State"), and serving to protect and increase property values in the City and the
State.
2. The C-210 Amendment for the New Area cannot be achieved by regulatory
processes or by the ordinary operation of private enterprise without resort to the powers allowed
under Sections 2.5, 41 and 43 of the Act because of lack of local public improvements, existence
of improvements or conditions that lower the value of the land below that of nearby land, or
other similar conditions, including without limitation the costs of the projects contemplated by
the C-210 Amendment and the necessity for requiring the proper use of land as to best serve the
interests of the City and its citizens.
3. The public health and welfare will be benefited by accomplishment of the C-210
Amendment for the New Area.
4. The accomplishment of the C-210 Amendment for the New Area will be a public
utility and benefit as measured by the attraction or retention of permanent jobs, an increase in the
property tax base, improved diversity of the economic base and other similar public benefits.
5. The C-210 Amendment for the New Area conforms to other development and
redevelopment plans for the City.
6. In support of the findings and determinations set forth in Sections 1 through 5
above, the Commission hereby adopts the specific findings set forth in the C-210 Amendment.
7. The estimated cost of the additional acquisition and development projects set
forth in the C-210 Amendment is $24,800,000. The Department does not at this time propose to
acquire any land or interests in land within the boundaries of the New Area. If the Department
proposes to acquire specific parcels of land, the required procedures for amending the C-210
Amendment under the Act will be followed, including notice by publication and to affected
property owners and a public hearing.
8. The C-210 Amendment is hereby in all respects approved and the Original Plan is
amended to include the C-210 Amendment. The secretary of the Commission is hereby directed
to file a certified copy of the C-210 Amendment with the minutes of this meeting.

9. The 2002 Resolution is hereby amended to expand the boundaries of the Original
Area to include the New Area. The New Area is hereby designated as an "economic
development area" under Section 41 of the Act.
10. Except.as stated herein, the terms of the 2002 Resolution remain in full force and
effect
11. Each of the amendments to the 2002 Resolution and the Original Plan set forth in
this Resolution and C-210 Amendment is reasonable and appropriate when considered in relation
to the 2002 Resolution and the Original Plan and the purposes of the Act. The C-210
Amendment and the 2002 Resolution, as amended by this Resolution, conform to any
comprehensive plan for the City.
12. The provisions of this Resolution shall be subject in all respects to the Act and
any amendments thereto.
13. This Resolution, together with any supporting data and together with the C-210
Amendment, shall be submitted to the City of Carmel Plan Commission (the "Plan
Commission") and the Common Council of City of Carmel (the "Council'), and if approved by
the Plan Commission and the Council shall be submitted to a public hearing and remonstrance,
after public notice all as required by the Act.
14. This resolution shall take effect immediately upon its adoption by the
Commission.
