Al Acquisition WHEREAS, the City of Carmel.Rcdevelopment Commission ("Cl iri the process of redeveloping blighted areas in the City of Carmel', Indiana; WHEREAS, in accordance with IND. CODE §36-7-14-19(b), and as evidenced by minutes of previous CRC meetings, Cl has approved and adopted a list (the "Property List") of the real property that may be acquirecl4br redevelopment (the "Acquisition Properties"); WHEREAS, certain properties currently owned.by Marshall E. Andich (°Andich") and located at 9-11 S outh R angeline R oad and 5 S'outh'Rangeline Road (tiro °Andich Properties") a re a mong t he Acquisition Properties; WHEREAS, CRC has caused there lobe completed two independent appraisals of the fair. market value of the Andich Properties; WHEREAS, the average of the two independent appraisals of'the fair market value of the Andich Properties is $346,000.00 (the "Average Value"); WHEREAS, the Property List, sets forth, ors hall set forth, prices for acquisition of the Acquisition Properties (the "Acquisiticn Amounts"): WHEREAS, the. Acquisition Amount for the Andich Properties is, or shall be; the Average Value; WHEREAS; CRC desires to acquire.the Andich Properres for redevelopment; WHEREAS, CRC intends to attempt to negotiate an agreementwith Andich for the acquisition of the Andich Properties for an amount-not greater than the'Average Value; WHEREAS, in the event that CRC is unable to negotiate an agreement,with Andich for the acquisition of the Andich Proper9ies, CRC intends to acquire the Andich Properties by the exercise of the power of eminent domain; WHEREAS, CRC desires to confirm that: (a) the Property List includes the Andich Properties; and (b) the AcgOsitlon Amount fortlie Andich Properties is the Average Value; and WHEREAS, CRC desires to adopt a resolution that: (a) permits it to negotiate an agreement with Andich for the acquisition of the Andich Properties for an amount not greater than the Average Value; and (b) in the event that it is not able to negotiate an agreement witH Andich for.the acquistion,of the Andich Properties, sets out its determination-to exercise thepower of eminent domain with respect to the acquisition of the Andich Properties; NOW, THEREFORE, BE IT RESOLVED THAT: 1. CRC herebyconfirms that: (a) the Property List includes the Andich Properties; and (b) the A0quisitton Amount for the Andich Properties is the Average Value; 2. CRC is permitted to negotiate an agreement with Andich'for the.acquisition: of the Andich Properties for an amount not greater than the Average Value; and 3. In the event that CRC is not able to negotiate an agreement with. Arid ich for the acquisition of the Andich Properties for an amou nt not greater than the Average Value, CRC is permitted to exercise its power of eminent domain with respect to the acquisition of the Andich' Properties.
