HomeMy WebLinkAboutCRC-06-2006?,r,. RESOLUTION NO. 6-2006 RESOLUTION OF THE CITY'OF'CARMEL REDEVELOPMENT COMMISSION APPROVING AN AMENDMENT TO THE'INTEGRATED ECONOMIC:DEVELOPMENT. PLAN FOR THE MERCHANTS POINTE ECONOMIC DEVELOPMENT AREA WHEREAS, on March.14, 2001, the City of Carmel;Redevelopment'Commission• (the "Commission"), as the governing body for the. City of:Carmel Redevelopment,;Department (the "Departnnent")„pursuant to Indiana Code 36-7-14„as amended (the "Act), adopted its Resolution No. 2005-2001 '(as subsequently confirmed and amended, the "Declaratory Resolution") designating; an area 'known as the Mercliants Pointe `Economic- Development Area (the "Economic Development Area" ),,as,.an economic. development, area pursuant to Section 4:1 of.thu Act, and'the°Commission.subsequently has,approved an lntegraied;Economic Development. Plan & Amended Redevelopment :Plan which applies to the :Economic Development Area (the "Plan'-'); and. WHEREAS, pursuaht to ;Sections 17.5 and 41 of,the, Act, the, Commission desires to amcnd the Declaratory. Resolution and the Plan by amending; the: boundaries of, the Economic Development Area io include, the territory described, in. Exhibit-. A attached hereto,, and by designating, the, territory described in Exhibit A as an "allocation area" (the "2006 Merehants' Pointe Allocation Area") under Section 39 of.the Aef(collectively, the '"Amendments"); and, WHEREAS, pursuant to Section 17:5(1) of the Act, the Commission caused to be, published a Notice of Public Hearing with respect to such proposed. Amendments; and WHEREAS, at the hearing (the "Public Hearing'') held by the Commission onthe 6ih day of February, 2006,.at 8:00 a.m., in the offices.ofthe;CityHall CaucusRooins,,located at One Civic Square, Carmel, Indiana, the. Comritission.heard=all persons interested in the proceedings and considered any written remonstrances thatwere filed and all ' evidence presented;=and WHEREAS, the Commission desires td take final,action approving the.Arnendments. NOW, THEREFORE, BE. IT RESOLVED by the City of -Carmel Redevelopment Commission, as the governing, body of the City of Carmel R"edevelopment Department, as follows: 1. After considering "the evidence presented at the Public Hearing, the Commission hereby finds and. determines that the Amendments are :reasonable and appropriate when considered in relation to the Plan and the purposes of`;the Act, and that the Plan, with the Amendments, conforms to the comprehensive plan for'the City of Carmel. The boundaries of the `Economic Development Area are hereby amended to "include the territory described in Exhibit'A hereto within the Economic Development Area. 2. The Amendments-are-hereby approved;,in-all respects. The Plan, as amended by Amendments„i's hereby confirmed in alfrespects. 'NDS014RJ &f9017v2 3. The 2006 Merchants Pointe Allocation Area described in Exhibit A hereto is hereby designated as an "ailocation area' pursuant to Section 39 of the. Act for purposes, of the allocation and,distribuiion of property taxes for,the purposes and iii the manner provided by said.. Section_39. Any real.property taxes subsequently levied by or for the beneffof any, public body entitled to a distribution of-property 'taxes on, taxable property, in the, 2006 Merchants Pointe Allocation. Area;shall be;allocated and,disdibute8 as follows: Except:as,otherivisa,pyoyided-in said Section 39, the,proceeds ofiax.es,attribuiable to the lesser of (a) the assessed value.ofithe, property for the assessment date-with respect to which the allocation, and4istributiomis made or (b) the7base assessed:Value shall be.allocated to and,, when collected, paid into the funds.of the rspective taxing units. Except: as otherwise provided in said Section 39, property tax,'proceeds in excess-of those'described in the previous, sentence shall be, allocated to tbe'rcdeveloprrient,district and, when collected, paid into an allocation fund for. the 2006 Merchants. Pointe Allocation Area,that,may be used. by the redevelopment district only to do one or more of the things specified in Section 39(6)(2) of-the.-Act., as the same `may be amended from time to time. Said allocation fund may not be used for operating expenses of the Commission. Except as otherwise .provided in the Act, ,beWc July 15 of each year, ?tbe Commission shall take the actions set forth in Section 39(b)(3) of the .Act: The foregoing allocation, provision shall apply to all of the 2006 Merchants Pointe Allocation Area and shall expire,on February,f, 2036. Each officer of the Commission is hereby authorized and directed to make any and all required filings with the Indiana Department of Local Government' Finance and. the Hamilton County,Auditor in connection"with the 2006.Merchants Pointe Allocation Area. 4. Any member of'the Commission is hereby authorized toulce such actions as are necessary`to impiementthe,purposes of this resolution, and any such action taken prior to `the date hereof is hereby ratified and approved. 5. The Secretary of the'.Commission•is directed to record this final action taken by the Commission pursuant.to the requiiements,of.Section 17.5'(g) of the Act. 1NDSC f.
