HomeMy WebLinkAboutCRC-07-2006RESOLUTION NO. 7-20&r RESOLUTION OF THE CITY OF CARMEL REDEVELOPMENT COMMISSION APPROVING AN AMENDMENT TO THE DECLARATORY RESOLUTION AND THE AMENDED REDEVELOPMENT PLAN FOR THE CITY CENTER REDEVELOPMENT AREA WHEREAS, on January 15, 1998, the City of Carmel Redevelopment Commission (the "Commission'), as the governing body for the City of Carmel Redevelopment Department (the "Department'), pursuant to Indiana Code 36-7-14,.as amended (the "Act), adopted its Resolution No. 3-1998 (as subsequently confirmed and, amended, the "Declaratory Resolution") designating an area known.as the City Center Redevelopment Area (the "Redevelopment Area"), . as a redevelopment area pursuant to Section 15 of the Act, and the Commission subsequently has approved an Integrated Economic Development Plan & Amended Redevelopment Plan which applies to the Redevelopment Area (the "Plan'); and WHEREAS, pursuant to Section 17.5 of the Act; the Commission desires to amend the Declaratory Resolution and the Plan by designating a portion of the Redevelopment Area described in Exhibit A attached hereto as an "allocation area" (the "Old Town Shoppes Tax Allocation Area") under Section 39 of the Act (the "Amendment'); and WHEREAS, pursuant to Section 17.5(a) of the Act, the Commission caused to be published a Notice of Public Hearing with respect to such-proposed Amendment; and WHEREAS, at the hearing (the "Public Hearing") held by the Commission on the 6th day of February, 2006, at 8:00 a.m., in the offices of the City Hall Caucus Rooms, located at One Civic Square, Carmel, Indiana, the Commission heard all persons interested in the proceedings and considered any written remonstrances that were filed and all evidence presented; and WHEREAS, the Commission desires to take final action approving the Amendment. NOW, THEREFORE, BE IT RESOLVED by the City of Carmel Redevelopment Commission, as the governing body of the City of Carmel Redevelopment Department, as follows: I . After considering the evidence presented at the Public Hearing, the Commission hereby finds and determines that the Amendment is reasonable and appropriate when considered in relation to the Plan and the purposes of the Act, and that the Plan, with the Amendment; conforms to the comprehensive plan for the City of Cannel. 2. The Amendment is hereby approved in all respects. The Plan, as amended by Amendment, is hereby confirmed in all respects. 3. The Old Town Shoppes Tax Allocation Area described in Exhibit A hereto is hereby designated as an "allocation area" pursuant to Section 39 of-the Act for purposes of the allocation and distribution of property taxes for the purposes and in the manner provided by said Section 39. Any real property taxes subsequently levied by or for the benefit of any public body entitled to a distribution of property taxes on taxable property in the Old Town Shoppes Tax Allocation Area shall be allocated and distributed as follows: Except as otherwise provided in said Section 39, the proceeds of taxes attributable to the lesser of (a) the assessed value of the property for the assessment date with respect to which the allocation and distribution is made or (b) the base assessed value shall be allocated to and, when collected, paid into the funds of the respective taxing units. Except as otherwise provided in said Section 39, property tax proceeds in excess of those described in the previous sentence shall be allocated to the redevelopment district and, when collected, paid into an allocation fund for the Old Town Shoppes Tax Allocation Area that may be used by the redevelopment district only to do one or more of the things specified in Section 39(b)(2) of the Act, as the same, may be amended from time to tune. Said allocation fund may not be used for operating expenses of the Commission. Except as otherwise provided in the Act, before July 15 of each year, the Commission shall take the actions set forth in Section 39(b)(3) of the Act. The foregoing allocation provision shall apply to all of the Old Town Shoppes Tax Allocation Area and shall expire on February 6, 2036. Each officer of the Commission is hereby authorized and directed to make any and all required filings with the Indiana Department of Local Government Finance and the Hamilton County Auditor in connection with the Old Town Shoppes Tax Allocation Area. 4. Any member of the Commission is hereby authorized to take such actions as are necessary to implement the purposes of this resolution, and any such action taken prior to the date hereof is hereby ratified and approved. 5. The Secretary of the Commission is directed to record this final action taken by the Commission pursuant to the requirements of Section 17.5 (g) of the Act. 2 INDSOI BIB 8190300 Adopted this 61h day of February, 2006. CITY OF CARMEL REDEVELOPMENT COMMISSION i ?. resident Vice President Secretary Me r I Member IND501 BJB MOM EXHIBIT A Description of Old Town Shoppes Tax Allocation Area The parcels to be designated as the Old Town Shoppes Tax Allocation Area is located inside the boundaries of the Redevelopment Area and is described as follows: Beginning at the point of intersection of the eastern right of way line of Rangeline Road and the south right of way line of Main Street (a.k.a. 131" Street), Then proceeding eastward along the south right of way line of Main Street (a.k.a. 131" Street) to the point of intersection with the west right of way line of I" Avenue SE, Then turning southward along west right,of way dine of 1" Avenue SE, to the point of intersection with the southern boundary of parcel # 16-10-30-03-01-005.000, Then turning westward along the southern boundaries of.parcels numbered 16-10-30-03-01- 005.000, 16-10-30-03-01-004.000, and 16-10-30-03-01-003.001, to the point of intersection with the eastern right of way line of Rangeline Road, Then turning northward along the eastern right of way line of Rangeline Road, to the point of beginning. Containing three parcels identified as: 16-10-30-03-01-003.001, owned by the city of Cannel, and 16-10-30-03-01-004.000, owned by Conrad Building LLC; and 16-10-30-03-01-005.000, owned by City of Carmel Redevelopment Commission, as depicted on the Hamilton County website and Online Maproom as of Tuesday, January 31, 2006.
