This property is an acreage piece that does not have neighbors in close proximity. The Neighbors are effected have approved the proposed variahce as evidenced by the letters attached. The Home Owners Association has also approved the proposed Variance. Dunbar FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: _The new garage that is proposed is going to sit back from the right of way in excess of 186 feet That makes It at least 200 feet from the road. We also have a very wooded lot so it will not negatively effect anyone's right to quiet enjoyment of their lot 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: 3. We are keeping the Single Family Residential use of the property and are not expanding the use in allY manner. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: We would need to park cars in the drive area and that would be more offensive than a new garage that would enhance the property. We also would encumber the views from the Crooked Stick Golf Course if we moved it to the rear of the Property. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. 07100013 DSV is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
