The applicant seeks the following development standards valiance approval:
Docket No. 07100016 V Section 25.01.B.3.b.i.b deck encroaching more than 3' into
easement
The site is located at 472 McLaren Lane and is zoned S2/Single-Family Residential.
Filed by Stephenson Residential, LLC for the owner.
General Info: The petitioner is
requesting to construct a screened room
addition to the rear (north) of the house.
The screened patio would encroach
approximately five feet into the drainage
easement that nms through the rear yard.
Analysis: The proposed screened
addition would be placed belween two
existing bays on the house (see arrow).
Approximately halfofthe addition
would be outside the easement, between
the bays, and the remaining hal f, fi ve
feet in width, would project into the
easement. The addition would be
cantilevered, so although it would
project five feet into the easement, the only part of the structure actually in the easement would be the 6x6
support beams. The addition would not be visible from the street. The County Surveyor's Office has
indicated that placing the addition in this location will not negatively impact this property or surrounding
properties.
Findings of Fact: Easement encroachment
I. The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: there will be no negative impact with regards to
drainage.
2. The use and value of the area adjacent to the property included in the variance will be not
affected in a substantially adverse manner because: there will be no negative impact with
regards to drainage.
3. The strict application of the terms of the Zoning Ordinance to the property will result in a
hardship in the use of the property because: the addition could not be built.
Recommendation: The Ocpt. of Community Services recommends positive consideration of Docket
No. 07100016 V.
