HomeMy WebLinkAboutCertification to City Council CERTIFICATION OF THE CARMEL PLAN COMMISSION'S RECOMMENDATION ON THE PETITION OF THE CITY OF CARMEL TO REZONE 56 PARCELS IN OLD TOWN AND ALONG THIRD A VENUE SW PURSUANT TO INDIANA CODE 36~7-4-605 ORDINANCE Z-510-07 To: The Honorable Common Council of the City of Carmel Hamilton County, Indiana Dear Members: The Carmel Plan Commission offers you the following report on the application (Docket Nos. 07070024 Z & 07080030 Z) of The City of Carmel, petitioning the Commission for a favorable recommendation to rezone 56 parcels located in Old Town and along Third Avenue SW, from B-lIBusiness, B-2/Business, B- 3/Business, and T-l/IndustTial to C-2/0Id Town. The Camlel Plan Commission's recommendation on the petition ofthe applicant is "FAVORABLE." At its regularly scheduled meeting on September 18, 2007, the Carmel Plan Commission voted seven (7) In Favor, one (1) Opposed (Eric Seidensticker), zero (0) abstaining, to forward to the Common Council the proposed Ordinance Z-510~07 with a FAVORABLE recommendation with the following Conditions: a) 3 parcels were removed from the list of affected parcels to be rezoned, and b) that sections for privacy and sun rights will be prepared for each project/site. Please be advised that by vutue of the Plan Commission's Favorable Recommendation, pursuant to Te 36-7- 4-608(f)(4), the Council has ninety (90) days to act on this petition before it becomes effective as Certified by the Commission. Ninety days from the date of this Certification (September 20, 2007) is Tuesday, December 19, 2007.
