The applicant seeks to create to rezone property from S 11 Residence to PUD/Planned Unit
Development for the purpose of creating a single family detached residential subdivision.
The site is located at 2000 W. 136th Street and is zoned S 1. Filed by Charlie Frankenberger
of Nelson and Frankenberger for Platinum Properties LLC and Pittman Partners Inc.
The applicant seeks to rezone 115 acres from S 1 to PUD for the purpose of creating a single
family detached residential community. The applicant has eliminated a portion ofthe proposed
project; the proposed Section 4 (Crook Property) is no longer part of this rezone. The new
density propose~ will be 1.23 units per acre. This project includes 38.6 acres of open space
(33%). The stahdard open space requirement for the Sl zoning is 15%, and S2 is 20%. See the
information packet for full detaiLs and revisions.
As proposed in the PUD, this process will also act as the Primary Plat. If approved as proposed,
there will not be further pubhc hearings for this project. Portions of this (construction plans)
will return for review by the Technical Advisory Committee and administrative approval of the
Secondary Plat only.
The City Forester, Scott Brewer, has preliminarily approved the landscape plan.
This project was heard at the March 20 Plan Commission meeting, March 29 Committee
meeting, and May 1 Committee meeting. The result from the Subdivision Committee meeting
was a 4-0 favorable recommendation to the full Plan Commission (with several conditions), such
as changing certain language in the PUD, traffic calming devices such as two roundabouts and a
wider main road, iron fencing, etc. See the information packet.
This project was also heard at the May 15 Plan Commission, discussed, and then sent back to the
Subdivision Committee for further review, after changes were made to the site plan only days
prior to the May 15 meeting. The most recent revision of this site plan (May 23) for Westmont
shows multiple landscaped islands as traffic calming devices, and a residential street width (not a
collector road width as suggested by the 20- Yr Thoroughfare Plan).
Not shown in the info packet are:
- a statement that fountains in ponds will be provided at the developer's discretion.
- a commitment to make the ponds more natural in shape (more undulating), and not as rectangular.
DOCS concerns and suggestions are as follow:
1. The addition of the traffic calming devices (landscaped islands) and the decision of the
developer to not widen the road pavement to match a "collector road" designation are
possibly acceptable. Petitioner must provide updates on Engineering Dept. approvals
2. On page 6 of the PUD - please show Cultured Stone as 'manufactured' or 'synthetic'
stone, so as not to refer to a specific name brand.
Carmel Engineering Dept concerns and suggestions are as follow:
1. The Engineering Dept. does not have any serious issues with the land plan, as proposed,
and will support the approval of the PUD (and, per the PUD, the Primary Plat) provided
that the petitioner provides written acknowledgement that sucb approval is conditioned
upon tbe resolution of all items in tbe letter dated March 13,2007 with tbe exception of
Items 51, 62, and 69-82 to tbe satisfaction of the City as the design progresses into the
Secondary Plat stage. Per Section 5.01.08, "Approval of a preliminary plat shall not
constitute approval of the final/secondary plat. It shall be deemed as an expression of
approval of the layout submitted on the preliminary plat as a guide to the preparation of
the final plat." Engineering shall consider approval of the Primary Plat as "an expression
of approval of the layout submitted" and to not include approval of the outstanding issues
outlined above. The petitioner has agreed to review the configuration of the 3-way
intersection at the southwest side of the 120' lots as the project moves into the Secondary
Plat stage.
The petitioner .should verify the constmction of the improvements stipulated by the
Thoroughfare Plan [or the 141st and 136th Street frontages.
This item should be discussed and the conceptual site plan/primary plat should be finalized
at this meeting.
The Department recommends this item be forwarded to the June 19 Plan Commission
meeting with a favorable recommendation, only after all questions/concerns have been
addressed.
