Docket No. 39-02 OA, 40-02 OA Amendments to the Carmel/Clay Zoning Ordinance - Use Table Adoption & Definitions Amendment (Text Amendments) The petitioner seeks to make amendments to the structure of the Ordinance relating to uses, add definitions and group all definitions into Chapter three of the Ordinance. Filed by the Department of Community Services. Please refer to the information distributed under a memo dated June 11 regarding these items. In addition a copy of this same information has been attached. The Department has been working for some time to develop a table that will relocate and replace the use information contained within the entire ordinance. This will make the process of identifying uses pemlitted within the different zones much more simple, In addition it will allow the Plan Commission and Department to conduct further review and revision to the table to assure the appropriate uses are pennitted within each zone. At this point we have identified all uses, grouped redundant uses into fewer categories, and ensured that there are clear definitions for each and every use category. Few changes have been made to the uses permitted under the current ordinance other than housekeeping related to the grouping of uses and the creation of definitions. In addition to providing definitions for each use, we propose to move all definitions within the ordinance to the Definitions Chapter. The following summary provides a brief overview of each of the three documents that has been provided. The first land use table is the final version that will appear in the Ordinance. It is broken down with all of the uses along the left hand side, and all of the zones along the top of the table. A key is provided at the top next to the title of the table. The intent ofthe table is to organize all of the uses from the Ordinance into one location that is easy to use and understand, and also to eliminate redundant uses that can be categorized into one single use. The table also eliminates the need to search through the entire Ordinance to find where a specific use is permitted. Another copy of the land use table is provided to show all of the changes that were made leading up to the final version. Every use that has been grouped has been stricken through, and there is an acronym immediately following the eliminated use to show what single use has replaced it. An example is an insurance office. It is being eliminated and replaced with general office (GO). A list of the acronyms is being provided with the table. A copy of the revised Definitions chapter is provided to show all of the neV.l definitions created from the land use table and the relocation of those definitions found elsewhere in the Ordinance. Any ne....v definition is highlighted in bold, and the source is in parentheses after the definition. Any deflllition that has been relocated from another chapter has the source chapter in parentheses after the definition. The Advisory Planning Law of the State of Indiana, as defIned in I.e. 36- 7-4-101. (adopted pel" Z-365-01) AGRICULTURE, GENERAL. The use of land fot agricultural purposes, including farming, pasturage, horticulture, floriculture, viticulture, and the necessary accessory uses for parking, treating or storing the produce; provided, however, that the operation of any such .accessory uses shall be secondary to the normal agricultural activities. The term agriculture does not include chemical storage or manufacturing associated with Agriculture. (Unified Development Ordinance, City of Noblesville, IN... Article 2, pg. 6) AIRPORT. A facility with surfaced runways and navigation devices for the takeoff and landing of aircraft and with or without services available far aircraft. . AIRSTRIP. A pemlanent public service way providing a secondary means of access to abutting lands. Any change in the supporting members of a building such as bearing walls, partitions, columns, bealIJ.S, girders, or any substantial change in the exterior walls or the roof. ALTERATION, SUBSTANTIAL. A stmcture or device that is used for the purpose of collecting or transmitting signals, images,. sounds, or information of any nature by wire, radio, visual, or electromagnetic waves, irtcluding but not linlited to directiollal or amm-directional antennas, panels, and microwave or satellite dishes. The term does not include an amateur radio station antenna. (adopted per Z-32 0) ANTENNA, DISH-TYPE RECEIVING (EARTH STATION OR GROUN'"D STATION). A signal receivirtg device, the purpose of which is to receive radio communications, television, data transmission or other signals from a satellite or satellites in earth orbit. Considered a stlucture, thus subject to all ordinances relating to structures. APARTMENT. A dwelling unit, primarily of a rental nature. AREA, BUILDING. see BUILDING AREA. AREA, COM:MON. Areas within a development that serve either a portion of or the entire development. (Ex.ample C011JT1lon area - signs, lighting, landscaping, maintenance shed, etc.) AREA, GROSS. Entire area of project or platted area. ART & MUSIC CENTER. A structure or complex of structures for housing the visual and/or performing arts. (Zoning Dictionary pg. 17) ART GALLERY. A room or structure in which original works of art or limited editions of original art are bought, sold, loaned, appraised or exhibited to the general public. .(A GlossalY of Zonillg... pg. 39) ASSESSED V ALUA TION. The monetary value placed on a propeliy and/or building as established by the assessor with authority over the jurisdiction of this ordinance. AUTOMATED TELLER MACHINE (ATM). A mechanized consumer banking device operated by a financial institution for the convenience of its customers, whether outside or in an access- controlled facility. A temporary shelter, erected and in place for less than six (6) months of any given year, supported entirely from the exterior wall of a building and composed of non-rigid materials except for the supporting framework. One decorative and non-commercial nature, clearly incidental and customary and commonly associated with any national, state, local or religious holiday. (Section 25,7) BASEMENT. A story having part, but not less than one-half, of its height below grade. A basement is counted as a story for the purposes of height regulation if sub'divided, used for dwelling pmposes other than by a janitor employed op the premises and/or as walk-out access. BED & BREAKFAST INN. A private, owner occupied business with 4 to 20 guest rooms where overnight accommodations and a morning meal are provided to transients for compensation and where the bed and breakfast inn is operated primarily as a business. The off-street area required for the receipt or distribution by vehicles of material or merchandise, which in tius Ordinance is held to be a twelve- foot (12') by forty-five-foot (45 ') loading space \"ith a fifteen-foot (15 ') height clearance and paved with a hard smface in accordance with the CWTent standards of the City of Carmel. BLOCK. A unit or property bounded by one or more streets and by streets and/or railroad rights-of-way, waterways or other barriers. BLOCK FRONTAGE. Propeliy having frontage on one side of a street and lying between the two nearest intersecting or intercepting streets, or nearest intersecting or intercepting street and railroad right-of-way, waterway or other barrier. BOARD. The CalmeVClay Board of Zoning Appeals. BORROW PIT. An area of land from which eaJ.i:h is H:moved for use on another site and a permanent or temporary irregular terrain is created. BUFFER, GREENBELT. The area of a development which abuts the perimeter of the development and which is designed specifically to provide a buffer and visual screen to adjacent land. BUFFER OR SCREEN, SOLID VISUAL, May include, but not be limited to a minimum five-foot (5') high solid evergreen hedge; stone, brick or wood fence; earth mounding or other suitable material or any combination a minimum of five (5) feet in height. If a chain link fence (with or without screen slats) is used, a minimum of five-foot (S ') high solid evergreen hedge shall be provided on the residential or commercial side of the fence. BUILD-TO LThTE. A line appearing on the development plan, stated as the setback dimension from the right-of-way along which a building far,;ade must be placed. (adopted per Z-340) BUILDING. A structure having a roof supported by columns or walls, for the shelter, support, enclosure or protection of persons, animals, chattels, or property. When separated by party walls, each portion of such a building shall be considered a separate structure. BillLDING HEIGHT. See HEIGHT, BUILDING. A building, together with its accessory buildings and use, where persons regularly assemble for religious purposes and related social events and which buildings, together with accessory buildings and uses, is maintained and controlled by a religious body organized to sustain religious ceremonies and purposes. Zoning Ordinance, Subdivision requirements; Sign Ordinance, Building Code applicable to such building, structure, or land in the zone in which it is located. (Section 34.0) CLINIC OR MEDICAL-HEALTH CENTER. The sum of the total horizontal areas of the, several floors of all buildings on a Lot, measured from the interior faces of exterior walls and from the center line of walls separating two or more buildings. A building in which one (1) but not more than five (5) guest rooms are used to provide or offer overnight accommodations to transient guests for compensation. HOUSE, ROW OR TOViTN. A series of two or more dwelling units, arranged side by side, separated by common walls between living areas, each unit having one or more levels. HOUSE PAD ELEVATION. The lowest outside finished ground elevation necessary to meet the minimtUll drainage requirements for the ground floor of a stlucture, ILLUMINATION. A1tificial light which shall not be blinking, fluctuating, or moving. Any building or group of buildings containing five (5) or more rooms with direct entrance to or from the outside, designed or intended to be occupied for sleeping pUl-poses by guests for a fee, often with a common kitchen and dining room facilities may be provided within the building or an accessory building, and which caters to the traveling public. The various products are then added together to give the total number of smoke units observed during the entire observation period. SOIL MAP. A National Cooperative Soil Survey prepared by U.S.D.A. Soil Conservation Service in cooperation with Purdue Experiment Station and the Hamilton County Soil and Water Conservation District, showing soil types aud composition of their locations. SPECIAL EXCEPTION. Pemrission for a conditional use of land which is granted because certain conditions will be met. The ordinance specifies what these uses may be. (See Section 21 ~ 0).
