Docket No. 39-02 OA, 40-02 OA Amendments to the Carmel/Clay Zoning Ordinance - Use Table Adoption & Definitions Amendment (Text Amendments) The petitioner seeks to make amendments to the struchlre of the Ordinance relating to L1ses, add definitions and group all definitions into Chapter three of the Ordinance. Filed by the Department of Community Services. The Department has done a final review of the LIse table to verify that it, as proposed, concurs with the existing Ordinance. As a result of that review some revisions need to be made to the proposed use table. The revisions include among other things: 1. The addition of the uses within the B-4 and M-2 zones that we are proposing to eliminate. 1 believe it is necessary to see these to complete the connection between the existing Ordinance format and the new use table. With all of the referring back to and forward from other zones. We will be using the "edited version" of the table as an administrative tool after the adoption of the new "clean" table. The edited version with acronyrnswill allow us to track the consolidation of uses. 2. The Department has added several "E" = excluded designations to the Overlays. These will appear in Green on the table. TIns was done now, as opposed to later this fall, as we had discussed returning the approved table to the Commission (Conunittee) this fall for a discussion of, "are the appropriate uses permitted in the appropriate zones". We believe that it is appropriate now, with the creation of the table. One thing that we have found is that the table makes it all to clear the there are many uses pennitted within zones today that do not want to be within the overlays. 3 . We also need to add some definitions and rearrange others. The way the definitions were laid out does not coincide with the use label on the table. We need to conect this for ease of use for the document. Also the definitions need to be amended to include the uses we are consolidating. Where we consolidate several uses into a single category we want to list those uses within the deFinition of the single new use category. This will provide certainty when determining what category of us a location falls into so we have to make fewer, more subjective, determinations. 1 will have copies to distribute for discussion at the meeting. The Department recommends that the Subdivision Committee forward this item back to the full Plan Commission with a favorable recommendation npon the conclusion of its review. Committee Reporl 2002-')-3 Background: The proposed table would relocate and replace the use information contained within the entire ordinance. This will make the process of identifying uses pennitted within the different zones much more efficient. In addition it will allow the Plan Commission and Department to conduct further review and revision to the table to assure the appropriate uses are permitted within each zone. At this point we have identified all uses, grouped redundant uses into fewer categories, and ensured that there are clear definitions for each and every use category. Few changes have been made to the uses permitted under the current ordinance other than housekeeping related to grouping of uses and the establishment of new definitions. In addition to providing definitions for each use, we propose to move all definitions within the ordinance to the Definitions Chapter. The following summary provides a brief overview of each of the three documents that has been provided. The first land use table is the final version that will appear in the Ordinance. It is broken down with all of the uses along the left hand side, and all of the zones along the top of the table. A key is provided at the top next to the title of the table. The intent of the table is to organize all of the uses from the Ordinance into one location that is easy to use and understand, and also to eliminate redundant uses that can be categorized into one single use. The table also eliminates the need to search through the entire Ordinance to find where a specific use is permitted. Another copy of the land use table is provided to show all of the changes that were made leading up to the final version. Every use that has been grouped has been stlicken through, and there is an acronym immediately following the eliminated use to show what single use has replaced it. A list of the acronyms is being provided with the table. A copy of the revised Definitions chapter is provided to show all of the new definitions created from the land use table and the relocation of those definitions found elsewhere in the Ordinance. Any new definition is highlighted in bold, and the source is in parentheses after the definition.
