Ordinance
The petitioner seeks to make amendments to the structure of the Ordinance relating to
uses, add definitions and group all definitions into Chapter Three of the Ordinance.
Filed by the Department of Community Services.
The Department of COlmmmity Services, as petitioner, requests that the City Council adopt a
request to amend the definitions and group all defmitions into Chapter Three of the Zoning
Ordinance and to make amendments to the structure of the Ordinance, relating to uses. (See
attached Ordinances).
The Carmel/Clay Plan Commission forwards both ordinances to the Common Council with a
(9-0) Favorable Recommendation (see attached certifications).
The Department recommends that these items be forwarded to the Annexation and
Land Use Committee for further discussion.
Background:
The proposed table would relocate and replace the use information contained within the entire
ordinance. This will make the process of identifying uses permitted within the different zones
more efficient. In addition, it will allow the Plan Commission and Department to conduct
further review and revision to the table to assure the appropriate uses are permitted within
each zone. At this point we have identified all uses, grouped redundant uses into fewer
categories, and ensured that there are clear definitions for each and every use category. Few
changes have been made to the uses permitted under the current ordinance other than
housekeeping related to grouping of uses and the establishment of new definitions. In
addition to providing definitions for each use, we propose to move all definitions within the
ordinance to the Definitions Chapter.

AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
An Ordinance Adopting Appendix A: Schedule of Uses into the Carmel/Clay Zoning Ordinance and
Amending all Sections affected thereby.
WHEREAS, the hierarchical structure of uses currently used in the Carmel/Clay Zoning Ordinance is
cumbersome and confusing to most people;
WHEREAS, the Carmel/Clay Advisory Plan Commission, at its regularly scheduled meeting au Tuesday,
July 15, 2003, recommended Favorable Consideration of Ordinance No. Z-415-03 by a vote of nine (9) in Favor and
zero (0) Opposed to Docket No. 39-02 OA; and
WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to amend the text of
the zoning ordinance; and
WHEREAS, pursuant to Indiana Code 36-7-4-610 and City of Carmel Ordinance No. D-1600-02, the
Cannel/Clay Zoning Ordinance is incorporated by reference into the Carmel City Code;
WHEREAS, the Common Council fmds that it is reasonable and necessary to promote and accommodate
the orderly growth and development of the City of Carmel and Clay Township by clarifying the uses allowed per the
Carmel/Clay Zoning Ordinance and easing the use of same;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as
follows:

The CarmeUClay Advisory Plan Commission offers you the following report on application
(Docket No. 39~02 OA) to the Commission to make amendments to the structure of the
Ordinance relating to uses.
The Carmel/Clay Plan Commission's recommendation on the petition is FAVORABLE.
At its regular meeting of October 21, 2003. the Cannel/Clay Plan Commission voted nine (9) in
Favor, zero (0) Opposed, zero (0) Abstaining, to forward to the Conimon Council the proposed
Ordinance No. Z-415-03 with a Favorable Recommendation.
Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant
to Ie 36-7-4-607(e)(3), the Council has ninety (90) days to act on this petition before it becomes
effective as Certified by the Commission. Ninety days from the date of this Certification is
Tuesday, January 20, 2004.
