CARMEL REDEVELOPMENT COMINUSSION Meeting, Tuesday,
October 16, 2007
President Ron Carter called the meeting to order at 7:01 p.m. Commission members
William Hammer and Jeff Worrell were present, constituting a quorum. Also present
were Mayor Brainard, Karl Haas, Les Olds, Darrell Norris, Francesca Jarosz (Indpls
Star), Rick Osborn, Marnin and Nora Spigelman, Brandon Bogan, Doug Adams,
Joseph Shanahan, Mike Anderson and Andrea Stumpf. Phyllis Morrissey as support staff.
Mr. Carter turned the floor over to Mr. Worrellfor a statement.
Mr. Won-ell stated lie wanted to make the other commissioners aware of some
accusations of conflict of interest directed at him, regarding sonic property he owns in the
city on Main Street in the Arts & Design District. Prior to accepting the appointment as a.
commissioner, Mr. Worrell told the Mayor and then get an opinion from the City
Attorney and also the CRC attorney; Karl Haas, and both determined his ownership of the
building would not be a conflict of interest. Mr. Worrell stated he thought the accusation
was politically motivated.
Mr. Haas pointed out the basic statutory test to determine under Indiana law, is that at the
time a vote was taken, the commissioner knew that there was an ascertainable pecuniary
interest in the contract or the action up for vote. Pecuniary interest means that there was
an interest or benefit or profit that is certain of calculation and could be determined. A
general benefit that would accrue to a commission member similar to or the same as what
would accrue to any other resident of Cannel or any other property owner is not a conflict
of interest. It takes a special kind of benefit and that benefit has to be financial and has to
be known by the commissioner in advance.
Mr. Haas: "I'm convinced that actions that the commission has taken relative to
properties on Main Street do not and,have not had any ascertainable benefit to any
property owner because it's not something where it's susceptible of determining in
advance how any nearby property owner might benefit, if there were to be a benefit. i
would note editorially, hopefully whenever the commission takes action it's beneficial to
property owners in Carmel. One of the purposes of a redevelopment commission is to
redevelop for the exactpulpose 01110t only making the city a better place to live but
increasing property values."
Mr. Worrell stated there was formal request made for his resignation and right now he is
not prepared to-resign his position.
Mr. Carter backed his decision and stated he [Mr. Worrell] has done absolutely nothing
wrong. No one on the commission has done anything wrong. This is politically
motivated. In fact, if someone were not able to serve on the commission by virtue of life
fact that they own property in the City, none o,f its would be able to serve on the
commission. As Mr. Haas has alluded to, the job of the commission is to increasethe
