20H. Docket No. 07090002 OA: US 31 Overlay - Hotel/Cultural/Entertainment uses
The applicant seeks to Amend the Zoning Ordinance, Chapter 23B: US Highway 31
Corridor Overlay Zone in order to limit hotel and other cultural/entertainment land uses.
Filed by the Carmel Department of Community Services.
This amendment proposes to place square footage limits on Cultural & Entertainment Uses in the US 31
Overlay Zone. The proposed limits match the limits currently in place for Retail uses in the Corridor.
Such uses would be limited to 15% of the Gross Floor Area of a building, or up to 30% in a building if
the total square footage does not exceed 15% of the entire development plan, and are located either on the
ground floor or below grade.
Several Cultural & Entertainment Uses are currently excluded completely from the Corridor, and are
listed as such in Zoning Ordinance Appendix A; this proposal will not affect them. However, this would
limit the square footage of the following LlSCS, which are allowed in the Corridor today:
Art Gallery
Art & Music Center
Hotel (full service)
Catering Establishment
Restaurant, without drive-thru food sales
Meeting or Party Hall
Museum
Stadium or Coliseum
A copy of the proposed language and applicable portions of Appendix A are enclosed in the info packet.
(Please note that the lndiana Code required 10-day public notice was achieved; however, the Plan
Commissi'Jll Rules of Procedure requires 25 days. To have the Public Hearing~ the Plan Commission
must vote to suspend their Rules of Procedure.)
The Department of Community Services recommends the Plan Commission forward this item to
the Nov. I Special Studies Committee meeting for further review. Or, if comfortable, vote to
suspend the rules and votc on this item tonight.
