The applicant seeks to Amend the Zoning Ordinance, Chapter 23B: US Highway 31
Corridor Overlay Zone in order to limit hotel and other cultural/entertainment land uses.
Filed by the Carmel Department of Community Services
The enclosed amendment proposes to place square footage limits on Cultural & EntertauIDlent Uses in the US 31
Overlay Zone. The proposed limits match the liJnits currently in place for Retail uses in the Corridor. Such uses
would be limited to 15% of the Gross Floor Area of a building, or up to 30% in a building if the total square footage
does not exceed 15% of the entire development plan, and are located either on the ground floor or below grade.
Several Cultural & Entertairunent Uses are currently excluded completely from the Corridor, and are listed as such in
Zoning Ordinance Appendix A; this proposal will not affect them. However, this would limit the square footage of
the following uses, which are allowed in the Conidor today:
Art Gallery
Art & Music Center
Hotel (full service)
Catering Establishment
Restaurant, without drive-thru food sales
Meeting or Party Hall
Museum
Stadium or Coliseum

23B.05.02
Retail and Service Uses:
Relail and Service uses may be included in one or more buildings within a DP. subject 10 the
following:
A. Retail and Service uses may l'Ol1lprise up to:
(I) Fiftt:en percent (15(;h) of the Gross Floor Area (GFA) of any building: or.
(2) Up to thirty percent (3Wif,) of the GFA of one building may be retail and service
uses. provided that:
(a) Tota] square footage of rerail and service uses designaTed in the
developmenl plan dOi:s not exceed Ii flecn percent (15%) of the GF A of
all buildings combined: or.
(b) Retail and service uses over fifteen percent (IY7p) of the GFA of any
one building he located on the ground floor (ll' below grade.
The Commission may granl a waiver to allow retail and service usc~ to he located on
!loors other than ground or helow-grade. pursuant to Ihe criteria found in Section
23B.02(G).
