HomeMy WebLinkAboutCRC-03-1997 Haceldell Pkwy/96th EDAR.ESOLLMONNO.3-- f'9 9 7 REs6Lt1TiON OF THE CITY OF CARMEL REDEVELOPMENT COMMISSION DECLARING AN AREA IN THE.CITY OF;CARMEL AS ECONOMIC DEVELOPIMENT AREAS AND APPROVING A DEVELOPMENT'PLANFOR SAID AREAS WHEREAS, the City of.Carmc-l Redevelopment Commission (the "Commission"),governing body of the City of.Carmel' Deparunent,of;Redevelopment (thc "Department'), pursuant to Indiana Code 36-7-14, as amended (the ",Act"), has thoroughly' studied that areas of the City, of Carmel, Indiana,(the "City"),,as=described on Exhibit A-l'and Exhibit A-2,a'aached hereto and designated as the "Plum Cr6ck/Ha2eldell Parkway Econom c Development Area" and the "96th Strect/Hazeldeli Pwl. vay`and the,EconomicDevelopment Area" (coiiectively, the "Ewnorrc Development Areas"); and WHEREAS, the.ex sting public'irdastruct re is.itiaflequie to service anticipated demand in ornear "each of the Economic Development Areas and WIIEREAS, the Commission has caused to be prepared',maps and plats showing,the boundaries of each of.the Ecohorric Development Areas;.ibe location of various parcels of pioperty; streets, allc is, and other features atlecting the acquisition, clearance,xeplatting; replanning; rezoning; or redevelopment of each of the Economic Development Areas, and-the parts of each ofthe'Economic Development:Areas acquired that are to be devoted' to public ways and other pubGcpurposes under the Plan (as hereinafter defined), lists of the owners of the various parcels of property to be acquired; and an.estimate of the cost of the acquisition and redevelopment; and WHEREAS; there has been:presented to this meeting for consideration and approvai,cf.the Commission a development; plan for the Economic'Develop_ment,Areas and entitled "Economic Development Plan-Hazeldell Pari.7way Economic Development Areas" (as it applies to each of the?Eeonomic.Development Areas, the "Plan"); and WI-IEREAS,'the Plan and supporting'data was reviewed and considered at this meeting, and WHEREAS, Sections 41 and 43 ofthe Actrhave, been created to permit the creation of °ieconomic development areas and to prmidc that all of the rights, powers; privileges and immunities that. may be,exercised by this Commission in a redevelopment area or urban rcheival area rhay be. exercised in an economic development area, subject to the conditions ser,forth in the Act,_and WHEREAS; the Commission deems it advisable_ to apply the provisions of said Sections 41 and 43 of the Act to the Plan. NOW, THEREFORE, $E IT RESOLVED by the City of-Carmel Redevelopment Commission, governing body of.City of Carmel Department of Redcvelopmerit, _as` follows: 1. The Plan for each of,the;Economic Development.Areas prombtes significant epportunities for the gaudul emplovmentof its citizens; attractsmajor new business enterprises'to,the City, retains or expands a significant business enterprise,eisting.in the boundaries of the.City,'and meet other purposes of 5ections•2.5, 41 and 43 of the Act, inciuding without limitationbenefiting;pubiichealth,.safety and welfare; increasing,the economic well being of the, Cirv and.the State of Iridiana (the "State"), and. serving to protect. and increase property values in the City and the State. 3. The Plan for each of the 'Economic Development Areas cannot be achieved by regulatory processes orhy the ordinary operation of private, enterprise ,without resort to the powers allowed under Sections 2:5, 41 and 43 of the Act'because of lack,of local public improvement; existence of improvements or conditions that lower the valuc of the land below that of ricarby, land, mmiltiplc; ownership of land, and other similar conditions, including without, limitation.the cost of the projects contemplated bythe Plan and the necessity for requ=g theproper use of land so as to best serve the interests of the City and its citizens. 3. The public health and welfare will be benefited by accomplishment of the'Plan.for each.of the Economic Dcvelopment-Areas: 4. The accomplishment of the Plan 'for each of the Economic Development Areas will be apublic utility and benefit as rneasured,by the attraction or retention of permanent jobs, an increase in the property "tax base, unproved diversity of-the economic`base:and other similar public benefit's. 5. The Plan for each of the,Econormic Development Areas conforms to other development-and redevelopment. plans for the.City. 5. In.support of the findings-and, determinations set forth in Sections 1 through. 5' above, the Commission hereby adopts the specific1iindings,set forth in the Plan. 7. WVhile the Plan:contemplates.some evenWal;property acquisition,.the'_Deparunent.does not at this time-propose to acquire any land or, interests in land within the boundanes of either'of:the Economic Development Areas. At,the time,the Department proposes,to'acquire specifcparcels ofland, the required procedures for amending the Plan under he Act_ will be.followed, including-notice by publication,. notice to affected,property owners and a,pubhc.hearing: 8. The Plan, is herebyin.all respects approved,.and the::secreta y of.the?Comuussion is Hereby directed to file a certified copy of dte,Plan with the minutes'of this meeting: Each of the Economic Development Areas is hereby designated declared and determined to,bc an "economic development;area" under Section 41 of the Act. 9. The provisions of this Resolution shall be subject in all respects,to the Acta id any amendments thereto. lo. This Resolution, together with-arty supporting data.and toget} er.with the_Plan, shall 'be subtturied to the City of Carmel Plan Commission,(the "Plan Commission'-) and the Common .Council of the City of Carmel (the " Common. Council") as,provided' in,the Act, and if.approved.bythe Plan Corniiussion and the Common Council shall be submittcd`to. a public hearingand'remonstfance as provided by, the Act_ after public notice as required by the Act.
