Re: Letter of Waiver Requests
Primary Plat for Rosado Hill Subdivision
Dear Ms. Conn:
On behalf of1be Petitioner, BSC II, LLC, an application for the Primary Plat of9.05:!:
acres for three (3) lots is being filed with the Carmel Department of Community Services. With
the application, a the fallowing waivers of the Subdivision Control Ordinance are requested:
1. Sections 6.03.03 & 6.03.04 Stub streets to adjacent parcels: We request a waiver of this
requirement as the proposed drive is a private drive and will not be dedicated to the City.
Additionally, the parcel to the south of the subject property is already subdivided with no
area for expansion.
2. Section 6.05.01 A1110ts shall abut a street: We request a waiver of this requirement as
all three proposed lots will have access to a public street via a platted and shared
ingress/egress easement. The terrain of the subject property limits the practicality of
multiple drives and the resulting common area on the perimeter ofthe proposed lots
creates a buffer of existing vegetation.
3. Sections 6.03.19 & 6.05.07 Homes must face parkway or collector roads: We request a
waiver of this requirement as the homes will face the proposed private drive. The
proposed lots are on top of a hill and are buffered from Spring Mill Road by the elevation
and existing vegetation.
4. Section 8.09.02 Installation of sidewalks or path along existing roads: We request a
waiver of this requirement as the terrain involved in the area requiring sidewalks or paths
is steep and would not be practical for this purpose.
