Filed by Matt Skelton of Baker & Daniels LLP for 56th Development, LLC. The petitioner seeks primary plat and subdivision waiver approvals for 14 residential lots on 9 acres. This is a density of 1.55 units per acre, and so, the development is subject to the requirements of the Open Space Ordinance. The minimum open space requirement is 20% and the petitioner proposes 22.5%. This parcel is heavily wooded, and tree preservation is key. The proposed 'pond' is a dry retention collection basin to remain dry most of the time. The Department does have concern with the subdivision waiver request for the percent of woodland clearing; the percent of woodland clearing allowed, about 30%, is based on the maturity of the trees. Tbe petitioner is proposing to remove approximately 72% of the existing wooded area. The City Forester relayed a concern about tree preservation on these wooded lots, and that there may be a conflict with tree preservation and citing these large homes & driveways on the proposed lots. At the OcL 2 committee meeting, the committee voted 3-2 to move the related primary plat item and street curvature radius waiver to the full plan commission with a favorable recommendation with the following conditions: 1) agrees to work with a registered consulting arborist, 2) driveways will be 16-ft wide or less and any additional driveway with will be composed of pervious pavers, and 3) the pedestrian path will be comprised of crushed stone. At the Oct. 2 committee meeting, the vote was 3-2 to keep this subdivision waiver item in committee and to have a tree inventory of trees 16 inches or greater in the non-hatched areas of the tree preservation plan, excluding ponds. .This tree inventory has been submitted. DOCS comments/concerns: 1) The City Forester received a copy of the tree inventory. While the inventory seems accurate, he has some concern about there possibly being too much use on the site. 2) The Engineering has no comment on this waiver request. 3) DOCS asks: Is it possibie to work with the City Forester and Parks Dept to do offsite tree remediation? Tbe Department of Community Services recommends tbe Committee vote on this waiver, whether it be positive or negative, and forward this item to the Dec. 18 Plan Commission meeting.
