HomeMy WebLinkAboutCRC-14-2001 Parkwood EDA??,w d/1,116/ RESOLUTION NO. 14"gdol RESOLUTION AMENDING RESOLUTION NO. 3-2001 OF THE CARMEL REDEVELOPMENT COMMISSION ENTITLED "DECLARATORY RESOLUTION OF THE CARMEL.REDEVELOPMENT COMMISSION" `d-?k.rred n/p9/o/ WHEREAS, the Carmel ('City") Redevelopment Commission ("Commission") did on January 10, 2001 adopt a declaratory resolution ("Declarator}, Resolution") establishing the Parkwood Economic Development Area ('Area") located in the City and, following a public hearing, the Declaratory Resolution was confirmed by a confirmatory resolution adopted on March 14, 2001; WHEREAS, the Declaratory Resolution approved the economic development plan ('Plan") for the Area which Plan contained specific recommendations for economic development in the Area; WHEREAS, the Declaratory Resolution established an allocation area in accordance with IC 36-7-14-39 ('Allocation Area") for the purpose of capturing property taxes generated from the incremental assessed value of real property located in the Allocation Area; WHEREAS, IC 36-7-14-17.5 authorizes the Commission to amend the Declaratory Resolution,.afier conducting a public.hearing, if it finds that: (1) The amendments are reasonable and appropriate when considered in relation to the Declaratory Resolution or Plan and the purposes of IC 36-7-14; and (2) The Declaratory Resolution and the Plan, as amended, conform to the comprehensive plan for the City; WHEREAS, the Commission now desires to amend the Declaratory Resolution to enlarge the Area and Allocation Area by the addition of approximately 23 acres of real estate (the "Additional Area" and "Additional Allocation Area," respectively) located in Hamilton County ("County") and contiguous to the Area and the Allocation Area (collectively, the Area and the Additional Area are herein referred to as the "Expanded Area") as set forth on Exhibit A; WHEREAS, the Additional Area is less than 20% of the original Area; WHEREAS, the base assessment date of the Allocation Area will remain March 1, 2000; WHEREAS, the base assessment date for the Additional Allocation Area will be March 1, 2001; 867036.1 WHEREAS, the-Board,of Commissioners of the County-did on October 22,,2061 assign the jurisdiction of the Additional Area to the Commission; WHEREAS, the Commission now desires to amend the Plan to_add the construction of certain inffastructure including road and utility improvements; WHEREAS, theCommission'hascaused tobeprepared afactual report ("Report'! in support of the findings contained in the Declaratory Resolution; which Report was attached to. and incorporated byreference in the Declaratory Resolution; WHEREAS, on November2, 2001, the Commission published notice of the substance of the proposed amendments. to the Declaratory Resolution and the-Plan in accordance WitN1C 36-7-14- 17.5 and IC 5-3-1 inthe'The Daily Ledger, posted notice at City 1-Tall, sent notice-by 'I" class mail to affected' neighborhood associations and property owners, and filed notice with appropriate agencies pursuant to IC,36-7-14-1'7(b), which"notice also,gave•notice of a hearing on the proposed amendments tape held by the Commission;' WHEREAS, the Commission desires to define "affected, neighborhood associations"- as that tern) is used in IC 36-7-14-1.7.5(e)(2) as' thoseneiehborhood associations that have registered with the Commission as -of January "1 of each-year,, and are located wholly or1n,part in the economic development or redevelopment•a ea in question; and WHEREAS, the Commission on November 14, 2001,i conducted a public hearing at which the Commission heard all persons. interested in, the proceedings and considered all written remonstrances and objections that were filed,, NOW, THEREFORE, BE IT RESOLVED BY THE CARMEL REDEVELOPMENT COMMISSION THAT, 1. The Commission hereby confirms the-findings, Plan and Report contained in the Declaratory Resolution, and finds that it will be, necessary to amend the Declaratory Resolution to expand the Area and Allocation Area'byapproximately 23 acres as set forth on Exhibit A and amend the Plan to include the construction of inffastructure including road and utility improvements in, serving or benefitting the. Expanded Area. These amendments are reasonable and appropriate when considered in relation to the DeclaratoryResolution and the Plan and to•the economic development purposes set forth in IC"36-7-14 2. The Commission hereby amends the Plan to add the construction of-infrastructure including road and utility improvements. 3, The Declaratory.Resolutionand the Plan, asamended,conform to thecomprehensive plan for the City. -2- . 967,036.1 4. The Declaratory Resolution is hereby amended to enlarge the boundaries of the Area and Allocation Area to include an additional 23 acres of real estate as shown in Exhibit A. The real estate shown in Exhibit A is less than 20% of the size.of the original Area. 5. This paragraph shall be considered the allocation provision for the Additional Allocation Area for purposes of IC 36-7-14-39. The Allocation Area shall continue to have a base assessment date of March 1. 2000. The Additional Allocation Area shall have a base assessment date of.March 1, 2001. Any property taxes levied on or after the effective date of this resolution by or for the benefit of any public body entitled to a distribution of property taxes on taxable real property in the Allocation Area and Additional Allocation Area shall be allocated and distributed in accordance with IC 36-7-14-39 or any applicable successor provision. This allocation provision for the Additional Allocation Area shall expire no later than 30 years after the effective date of this resolution. 6. Pursuant to 1C 36-7-14-17.5(h), the Commission hereby finds that a neighborhood association is an "affected neighborhood association" for purposes of IC 36-.7-14-17.5(e)(2) if said association has registered with the Commission as of January 1 of that year and is located wholly or in part in the economic development or redevelopment. area in question. 7. The Secretary is instructed to submit this Resolution to the Common Council for approval of the enlargement of the Area. 8. The Secretary is hereby directed to record this Resolution with the Hamilton County Recorder; immediately to notify the State Board of Tax Commissioners of the expansion of the Allocation Area and the Area and to file this resolution, together with a list of parcel identification numbers representing the Additional Allocation Area and a map of the Additional Allocation Area with the Hamilton County Auditor. 9. In all other respects, the Declaratory Resolution and Plan.are hereby ratified and confirmed. 10.
