HomeMy WebLinkAboutCRC-11-2001 Merchants Point EDARESOLUTION NO. /1- 2001 AMENDING DECLARATORY RESOLUTION 2005-2001 OF THE CARMEL REDEVELOPMENT COMMISSION WHEREAS, the City of Carmel ("City") Redevelopment Commission ("Commission") has investigated, studied and surveyed economic development areas within the corporate boundaries of the City; and WHEREAS, the Commission has selected an economic development area to be developed under IC 36-7-14 and IC 36-7-25 (collectively, "Act"); and WHEREAS, the Commission has prepared an economic development plan ("Plan") for the selected economic development area, which Plan is attached to and incorporated by reference in this resolution; and WHEREAS, the Commission has caused to be prepared: (1) Maps and plats showing: (A) the boundaries of the economic development area, the location of various parcels of property, streets, alleys, and other features affecting the acquisition, clearance, replatting, replanning, rezoning or redevelopment of the economic development of the area, indicating any parcels of property to be excluded from the acquisition; and (B) the parts of the acquired areas that are to be devoted to public ways, levees, sewerage, parks, playgrounds; and other public purposes under the Plan; and (2) An estimate of the cost of redevelopment and economic development; and WHEREAS, IC 36-7-14 and IC 36-7-25 (collectively, the "Act") authorize the Carmel Redevelopment Commission ("Commission') to declare an area to be an economic development area and to establish an allocation area within an economic development area providing for the distribution of property tax revenues generated within the allocation area; WHEREAS, the Commission adopted a Declaratory Resolution ("Declaratory Resolution') on March 14, 2001, which was effective as of that date, was confirmed bya Confirmatory Resolution ("Confirmatory Resolution") adopted on May 24, 2001; WHEREAS, the Commission, by the Declaratory Resolution, as confirmed by the Confirmatory Resolution ("Area Resolution'), established the boundaries of the Merchants' Pointe Economic Development Area ("Economic Development Area") and declared this area to be an economic development area and the Economic Development Area is more particularly described in the map attached to and incorporated in the Declaratory Resolution; WHEREAS, pursuant to the Area Resolution, the Commission approved an economic development plan for the Economic Development Area was adopted ("Economic Development Plan");. WHEREAS, pursuant to the Area Resolution and the Economic Development Plan, the Area") for purposes of capturing incremental ad valorem real property tax revenues levied and collected in the Allocation Area to pay debt service on bonds issued to finance the economic development projects described below and to pay certain other costs permitted by the Act and this Resolution; WHEREAS, the Commission has determined that the amendment set forth below is reasonable and appropriate when considered in relation to the Area Resolution and the Economic Development Plan for the Merchants' Pointe Economic Development Area when considered in relation to the original Declaratory Resolution and the Economic Development Plan for the Merchants' Pointe Economic Development Plan and the purposes of the Act; and WHEREAS, the Area Resolution, with the proposed amendment, conforms to the comprehensive plan for the City of Carmel; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION THAT: (1) The Commission now finds that the addition of certain parcels to be acquired in connection with carrying out the Economic Development Plan for the Merchants' Pointe Economic Development Area is (the "Plan") reasonable and appropriate when considered in relation to the Area Resolution and Plan and the purpose of the Act. (2) The Commission further finds that Area Resolution and Plan, as amended, conforms to the comprehensive plan for the City of Carmel. (3) The Commission proposes to acquire interests in real property within the boundaries of the Area. The parcels to be acquired in carrying the Economic Development Plan for the Merchants' Pointe Economic Development consist of those parcels listed on Exhibit A attached hereto and made a part hereof. (4) Except as set forth herein, the Area Resolution remains in full force and effect.
