RESOLUTION NO. Z-2001
WHEREAS, the City of Carmel Redevelopment Commission ("CRC") is a governmental body
that, from time to time, makes expenditures of public funds;
WHEREAS, I.C. 5-22 (the 'Act'): (a) applies generally to the expenditures of funds by
governmental bodies; and (b) contemplates specifically that each governmental body that is a purchasing
agency will have designated a purchasing agent;
WHEREAS, CRC: (a) has designated the President of CRC to act as the purchasing agent
for CRC when CRC, as a purchasing agency, is making expenditures of public funds that are subject to the
applicability of the Act (the "CRC Purchasing Agent");
WHEREAS, CRC has resolved that the CRC Purchasing Agent will have all of the power and
authority granted and extended to purchasing agents under the Act, except as such power and'authority may
be limited or circumscribed by rules and regulations that are: (a) adopted and approved by CRC; and
(b) permitted by I.C. 5-22-3-3 and other applicable laws of the State of Indiana (the "CRC Purchasing Rules");
WHEREAS, from time to time, CRC enters into contracts with suppliers, service providers and
other contractors (the "CRC Contracts"), some of which contracts require CRC to make expenditures of:
(a) public funds that are subject to the applicability of the Act; (b) public funds that are excepted from the
applicability of the Act; or (c) funds that do not constitute public funds, in which case the expenditures are not
subject to the applicability of the Act; and
WHEREAS, from time to time, it is appropriate to enter into change orders or contract
modifications with respect to the CRC Contracts (the "Change Orders"), and CRC desires to adopt and
approve a CRC Purchasing Rule that empowers and authorizes the CRC Purchasing Agent to enter into
Change Orders without any action or approval by CRC; provided that the Change Order: (a) does not
(individually or collectively with other Change Orders entered into by the CRC Purchasing Agent without action
or approval by CRC) increase the price, compensation or other amounts payable by CRC under any CRC
Contract by more than 5%; and (b) is permitted,by all other CRC Purchasing Rules adopted and approved
by CRC from time to time, I.C. 5-22-3-3 and all other laws of the State of Indiana.
NOW, THEREFORE, BE IT RESOLVED THAT:
CRC hereby adopts and approves a CRC Purchasing Rule that empowers and authorizes
the CRC Purchasing Agent to enter into Change Orders without any action or approval by.CRC; provided that
the Change Order: (a) does not (individually or collectively with other Change Orders entered into by the CRC
Purchasing Agent without action or approval by CRC) increase the price, compensation or other amounts
payable by CRC under any CRC Contract by more than 5%; and (b) is permitted by all other CRC Purchasing
Rules adopted and approved by CRC from time to time, LC. 5-22-3-3 and all other laws of the State of Indiana.
Passed by the Redevelopment Commission of the City of Carmel, Indiana, this 101" day of January, 2001,
by a vote of s ayes and 0 nays.
