13925 Illinois. We have received our GDR from the state for the second building and I would like to
schedule our preconstruction meeting with you. Do you have any time on Thursday morning the 91h or
Friday the 10th? The building was approved through ADLS, and the entire project went through TAC when

I'm not sure that we have seen plans for this, The plans we approved in 2003 only included Phase I
construction and only included the existing ''building adjacent and parallel to the west r.o.w. of 1 31
and partial parking to support the building. This was labeled as building A. I have included Nick
Redden on this distribution since Nick is involved in project review.

2 am not so worried about drainage, because I {now it was all waster planned when the?CMC
development was done. What Y need. to know is building locations, as we have easements on
the parcel ane just want to verify they are not in cur easements. You have anything that

This item went through in 2006 under docket no 06010026 adls amend. It was approval for the second building,
and only needed subcommittee approval, since the overall development was proposed and approved by the full
plan commission on a date prior. You may have to work independently with the property owner to have your dept.
review the new proposal. I am not sure if this is agreeable to you or not; but you can always cross reference your

If this project was previously approved, please submit to our oftlce:
1) A copy of the approved Storm Water Pollution Prevention Plan (SWPPP)
2) A copy of the official SWPPP approval form from John South, with the Hamilton County Soil and Water
Conservation District
3) A copy of the 1 6 Notice of Intent (NOI) that was previously submitted to the Indiana Department of
Environmental Management.
If the SWPPP was not approved by John South, then the City will have to approve it now before this project can
proceed Also, Rule 5 NOls are only valid for five years. So if an NOI was obtained in 2003, then it is
approaching expiration and may need to be resubmitted.

We are in receipt of the plans and emails you sent. However, these plans are identical to the approved
plans we have in our files. The issue is that the plans approved by the Engineering Department did not
include the entire business parF-. -Normally, approval is sought for the entire development. However,
that was not the case. Approval was given by this department for only Phase 1 which included the first
building and the parking and storm drainage to support the building. isTwas the way the plans were
submitted. The approval did not include the remaining 2-buildings and parking, grading, etc. for the
remainder of the site. w e ge, we -received-construd ion plans beyond Phase 1. If
you are requesting our approval of the remainder of the site, we will need construction drawings to that
effect. The existing construction on said drawings should be shown as existing/previously approved,
highlighted appropriately and indicated as such on the title sheet and all appropriate sheets of the plans
submitted for review and approval.
Additionally, we will require a Certified Engineer's Estimate and Performance Guarantees for the
following improvements:
Erosion Control
Illinois Street Right of Way Improvements at entrance
Water Mains if applicable
Since this site is now within the service area of Carmel Utilities water distribution, BPWS Water
Availability approval will be required for the remaining 2-buildings. This approval is based upon usage,
of the buildings and is an EDU approval. Based upon the previously approved drawing, the remaining
2-buildings contain 37,145 ft' each. If this has changed, please advise. The EDU calculation is:
37,145 ft' @ 0.5 EDUs/1000 f12 (office classification) = 18.5725 EDUs each or 37.145 EDUs total.
Water Connection Fees for the 2nd building to be constructed would be:
18.5725 EDUs @ S1396.00 Connection Fee/EDU = $25,927.21
Availability (acreage) Fees would not be applicable. Please contact John Duffy of Carmel Utilities to
confirm this information.

'Mere is a request for a pre-subm ltal for this project. The Engine Zrg Department approved plans for the CHIC
Properties Business Park. Phase 1 on January 10;2003. However /the plans we approved only included what is
now the existing building adjacent to the US 31 right of way, which was also referred to as Building A. the
parking to support this building, the access drive plus detention pdnds. There were 2-buildings referenced as
future proposed office buildings and the remainder of the parking eferenced as future construction. Normally in
cases like this, final overall plans are presented and approved and the buildings develop, they pay fees and
don't have to go through the review process. Also, at the time the t rst building was constructed, it was within the
service area of Indianapolis Water, not Carmel Utilities as it is now. 1 assume any new construction would be
required to possible post performance bonds if required, obtain BPR Water Availability- approval and pay
Carmel Utility Pees.
We have not seen any new plans representing what is now, goine to be ponstructed. Can you shed any light on
this issue and suggest how' we might proceed? Thanks.

I have spoken to Daren Mindham, the Urban Forester now overseeing the final site inspections, and he has told,
me that because of the hot dry weather, generally the dales for digging plant materials have been pushed back
two to three weeks. So he has given you until November 1, 2007, to get plants in the ground, and the
landscaping situation finished up on building 1 and the parking iot. That is an extension to your letter that is in our
file with.the plan.
For me, that is a sufficient commitment on the landscaping to allow you to beein the building 2 process. If the
process spirals out of control, and the landscape does not get resolved, we can always issue a stop work order,,
but I [rust that will not be necessary here. Call or email me if there are further questions or comments.

We will approve the Phase 2 plans with this understanding. We will place a hold on the final C.O. until the
additional turn lane is installed. Please submit the requisite number of plans for approval. Any other bonds must
be provided and any fees paid prior to approval of the plans. Please contact Dick Hill. The Contractor must obtain
a right-of-way permit from Fred Glaser before construction equipment accesses the site. The pending
performance bonds for the right-of-way improvements shall satisfy the bonding requirements of the right-of-way
permit.
When any outstanding fees have been paid, the Department will approve the plans and the Department will notify
Building and Code Enforcement that we have not further issues with the release of the ILP. In the event that the
required bonding has not been provided by November 16th, the Department will issue a stop work order for all
work on the site. In the event that construction equipment accesses the site without a right-of-way permit, a stop
work order wilt be issued immediately.

Per our meeting yesterday, I am writing to confirm our conversation:
1. The grades for the phase 2 portion of the project have not changed and are the same as they were when
phase 1 was submitted.
2. We understand that the added turn lane will need to be bonded and constructed before a certificate of
occupancy will be granted. We will have the existing entrance surveyed and a new grading plan prepared
for your review. This work will not prevent the developer from obtaining a building permit so long as the
bond for the full amount of the additional lane, including that portion outside of the city's right of way, is
included in the amount of the bond.

As far as Drew is concerned CMC is now in direct violation of their IDEM permit because we are riot mairitainirig
the lines and even though this is not ours to maintain all specifications must be adhered to. Secondly € believe
the confusion has come because initially with the pre-submittal calling the proposed building "A'" and I have
always referenced the TC to be adjusted as 871.60 which is still not adjusted. What we will do though is alloy a
conditional permit stating that MH ##600 must be adjusted to 1' lower than the FIFE (low profile casting may work)
before we allow a final conneclieniinspeclion. We still must have in hand the Bond prior to permitting. Thanks!

(OR) Would you prefer to give each building a separate street address? I believe that the first building is listed as
Phase I, 13295 Illinois St., Bldg B.
Ryan - The last email that I have is one you sent to Sarah Lillard on 11!20107 in which you had an issue with the

Once you have sent me the email, I will formally email several City and County agencies to officially verify
the status of the project. You will be copied on this email and will receive any replies regarding
outstanding items. If any are cited, you will need to contact that agency to clear up the issue. Once all
items are complete, we will contact you to schedule the meeting. The meeting date is normally set within
one or two days from that contact.
In your case, agency responses should be very quick and we could have the meeting on Monday or
Tuesday. Please let me know if you have any questions.

Yes, you are correct in the whole site went through TAC previously. But since then, we
have seen different things then what went through TAC the first time. I don't need a;full
set cf plans, as I know drainage and everything is taken care of, but if you could e-mail
me a copy of the development plan or something that shays building location, it would be
great. That way I can at least look at it and see exactly what I am being ask to
authorize. If you have any questions, please let me know.

Pursuant to our scheduled meeting tomorrow morning at 10:00 a.m., we are requesting a letter of commitment
from CMC stating that the remaining work on the first building of the project be completed in the next two weeks.
In anticipation of CMC's letter of commitment and the completion of the work on Building 1, Jim Blanchard has
agreed to proceed with the pre-submittal meeting for the second building with the condition that only the footings
can be completed. When the work is completed on Building 1 and passes Forestry's inspection, work can proceed
on Building 2.
Please let us know if you have any questions or if we can be of assistance in any way. We look forward to
meeting with you tomorrow.

I have received the plans that you sent and r do not see the regulated drain easements
shown in the plans. I know the easement were shoran on the plat and then a correction was
also filed at our request, since some of our pipes ended up outside the platted easement.
Your company did both the plat and the correct, so it would be nice to see them on the
plans. I can't verify the building is outside the easements unless I see them together.
if you could just put the easements on sheet C103 and e-mail that to me, I can get the
release to Jenny at Carmel ROCS. if you have any questions, please let me know.

I see you say the plat is overlaid, but we requested and Schneider did a Certificate of
Correction tc the plat for the J.R. Collins Legal Drain Easement in 2006 I believe it
moved some of the easement lines around the pond, along with other easement lines. Y know
the document was recorded as instrument number 2006 00057917 in Hamilton County Recorders
office. Can you verify than document did not move the easement line along the north
boundary of the pond- Please let me know.

To review the items we will need to complete the pre-submittal process:
1. Water/sewer permit
2. Letter of Commitment to complete Building One of the CIVIC project. The letter should be on your company
letterhead with the body of the letter stating what remains to be done, the intended completion date, and
signed by the appropriate individual from your company. Please gel this letter to our Building & Code
Services Department at your earliest convenience.
As we discussed in the meeting, it appears that you are working with Scott Brewer & Daren Mindham to
complete this work by the end of this week.
Scott and I spoke about your request to submit the original landscape drawings for this second building. Scott has
given a verbal okay to this request.
An Alarm Permit Application will also need to be filled out for this project but will not hold up the pre-submittal and
subsequent building permit.

I looked in our check drawer and found the check along with some paperwork including a sewer/water application

I have your Permit #07120064 ready for pick up. The total amount due is $9,169.00 which is
payable by check. made out to the City of Carmel. Our hours tomorrow are 8:00 am - 5:00 pm.
I am not in the office on Fridays but will email von on Monday to discuss where we are on
the issues. Jim just wanted to make sure we prepared your permit by Friday as discussed.
