This item is approved with the understanding that it is the homeowner's responsibility to maintain adequate drainage that will not adversely affect any adjacent property. 2. Backfill - to occur on north side of property from house to retaining wall which is to provide a more gradual slope on property. This item is approved with the understanding that it is the homeowner's responsibility to maintain adequate drainage that will not adversely affect any adjacent property . 3. Removal of existing wood deck. This item is approved. 4. Addition of 404 Sq. Ft. Patio. To replace wood deck and be constructed of Paver stones. This item is approved. 5. Addition of Natural.stone steppers from new paver patio to existing driveway. This item is approved. 6. Extension to existing beds and addition of new beds. This includes plantings and location of such as shown on the submitted diagram to the ACe on May 21,2007. This item is approved. 7. Addition of Solid Cedar wood fencing to connect to existing wall and outline rear and side property line. This item as proposed is denied. 8. Addition of iron mesh fencing (as pictured with 5/22 email) to connect to existing wall and outline rear and side property line. This item is denied. By establishing a clear standard within the community, we want to eliminate controversy among the individual homeowners. The standards are as follows: . All fencing and rehab fencing must be approved. . No fencing on lake lots. . Black, wrought~iron style fencing only. o Fence to sit 2' inside side-lot boundaries unless written approval of neighboring lot owner to place on property line. Exception given to Lot 39-40 where fencing will be allowed on property line and will attach to Frontage fencing. . Fence must be at least 4' high and not to exceed 6' high. As mentioned, the two fences in the neighborhood that do not meet these guidelines were constructed prior to the homeowners taking control of the Homeowners Associaticl,n from the Developer. Fencing has always been a sensitive issue for parents and pet owners alike. It is apparent you and Lilah have put a tremendous amount of time and energy on your landscaping proposal. We are not ignoring or belittling your concerns/needs, but are trying to maintain consistency. Please feel free to submit other fencing options for review. . It is reprehensible that the signage announcing the zoning variance request was not displayed within the subdivision and the community not informed by the board. This demonstrates the Board's penchant for self-service. The fence should not be allowed since it contravenes the zoning requirements and the subdivisions fencing guidance.
