Dear Christine and Angie:
Enclosed please find the following:
1. An original and one (1) copy of a Use Variance Application seeking
permission to operate a low-impact professional office use on the real estate
located at 410 First Avenue, N.E., as well as copies of the deed, tax card and
photographs of the site; and,
2. An original and one (1) copy of a Developmental Standards Variance
Application seeking relief from the sidewalk requirement and bicycle parking
requirement of the zoning ordinance, as well as copies of the deed, tax card
and photographs of the site.

My understanding of the schedule is as follows:
1112/2007 File application
11120/2007 E-Mail notice to Indianapolis Star by noon for publication
11/22/2007 Publish notice in the Indianapolis Star; post sign on property; mail
certified mail to surrounding property owners;
12/7/2007 By noon submit informational brochures to staff
12/17/2007 6 p.m. Board of Zoning Appeals hearing (I would like to discuss with you
whether or not this matter can be heard by a hearing officer)
As I explained in an e-mail message to your office on October 31, Jim Euler,
Managing Member of DECA Holdings, LLC previously filed a rezone application under
Docket No. 07090013Z; however, after speaking with Angie on this project, we agreed
that the better avenue to pursue would be a use variance; consequently, we have formally
withdrawn the rezone request and are now pursuing the Use Variance Application and
Developmental Standards Applications.
Please note, this matter did appear before the Technical Advisory Committee on
October 17, 2007, and there were no significant comments regarding the project. In this
regard, please confirm for me that this project does not require any ADLS
amendment approval because no substantial alterations will be made to this site and
that this matter does liot require further T AC review because it was already
reviewed by the T AC agencies in October. My. Euler does propose to replace the roof
on the structure. However, it is my wlderstanding that there will be no signage on the site
and no substantial site alterations that would require any further TAC review or any
review by the Special Studies Committee for an ADLS amendment. Please confirm that
my understanding is correct.
Also, due to the low impact nature of this request, please advise if this is the
type of request that can be heard by the BZA Hearing Officer.
My understanding is that you will assign the appropriate docket numbers to these
Variance Requests and provide me the filing fees for the same. Please be sure to place
this matter on the Board of Zoning Appeals agenda for its December 1 ih meeting and
contact me should you have any questions. Thank you for your assistance in this matter
and contact me with any questions.
