HomeMy WebLinkAboutCorrespondence ;C, -:;;,1_~ A CR White Development, LL C Phone: 317-848-2830 Fax: 317-571-8840 Email: cwlhite@indy.rr.com Chris White 510 Fox Lane Carmel, IN 46032 Re: Front Setback -See 26.27 May 13, 2002 John Dobosi\\'iez City of Carmel One Civic Square Carmel, IN. 46032 Dear John: I understand that a meeting of the sub-committee of the Carmel Plan Commission will meet on Tuesday May 14th to discuss an amendment or clarification to the Carmel Subdivision Ordinance for front yard setbacks ( Section 26.2.7 ), It is my lillderstanding that staff is interpreting this section to require that a house must have a 5 foot off-set to be permitted to have a 20 foot front yard setback or it must be at 40 feet for an S-I zoned property if it has no off-set. I served on the Cannel Plan Commission at the time this ordinance was amended and also served on the conunittee that reviewed the changes to the open space ordinance during this time frame. The ordinance was originally 25 feet for the cluster or open space ordinance, As changes where discussed to the ordinance, it was decided to allow setbacks of less than 25 feet to allow for a neo-traditionallook and to allow small lots with an alley concept to be deveLoped with the homes closer to the street. The five foot off-set was discussed to permit at least 25 feet of driveway to the garage to allow cars to be parked in the driveway so as to not block the sidewalk at the front of the house. The discussion that all homes in the City of Cannel MUST have a five foot off-set was not discussed and in my opinion was not the intent of the ordinance change, To require a home that does not have a five foot off-set to be moved back to 40 feet defeats the intent of the open space ordinance, which was to design homes on smaller lots with the open space behind the home for the homeowners to enjoy. This goes against all recent planning trends that I know of. In my opinion a home that is setback 25 feet from the right-of- way should be able to have any architectural design that the particular house dictates. If a home is designed closer than 25 feet, then it must have at least a five foot off-set to the rear for the garage so that a 25 foot parking stall is created between the driveway and the garage. If a home has a side load garage the ordinance states that an eight foot off-set is allowed for a 15 foot setback. This again allows a 23 foot setback plus 2 foot from front of garage to driveway edge to create the 25 foot spacing between the sidewalk and driveway bend for a side loaded driveway. I do not remember any discussions on architectural style of home dictating the front set-back My personal home is a very expensive custom home mth a side load garage. The home does not have an eight foot off-set to the rear, and in fact has a 3 foot offset to the front of the home to allow the third car garage which is the case for most homes with more than a two car garage. My home would not meet the interpretation that you are promoting ,vith-out setting the home back 40 feet for a side load condition. Presently my home is set-back 30 feet from the right-of-way. I am presently working with the Jones Company on the Preliminary Plat approval of Aberdeen Bend, We have proposed a 25 foot setback for this project to require that all homes will have the 25 foot spacing between the garage and the sidewalk. I have enclosed a packet of the proposed homes that Jones will be building in this community which will range from a base price of $250,000 to $400,000. Not your typical first time buyer home. As you earn see from the booklet that these homes are very appealing and that most of the homes do not a five foot off-set back from the front of the home to the May 12,2002 garage. Most of the off-sets are slightly forward to allow a third car garage. This is the way most homes are designed today including custom homes. To change the ordinance the way you are proposing it would require that almost all builders would have to redesign their homes or move the home back to a 40 foot front setback. Again 40 foot setbacks are not today's trend in design either. I hope that you reconsider the affects that your new interpretation creates. I believe that the only change you need to create is that if a home is setback 25 feet that no off-sets are required. This would allow for cases where you want to allow the homes to be built closer to the street for rear alley and neo- traditional designs and still permit the typical home oftoday's standards to be built in Carmel without a total redesign. I unfortunately can not be at the Tuesday meeting as I have a rezoning meeting in McCordsville. Ten (10) feet - for structures with rear loading oraUey access garages. '1.6.2.1 Required front yards in residential districts shalL be devoted entirely to Landscaped area except for frontage places, guest parking and the necessary paving of driveways and sidewalks to reach parking or loading areas in the side or rear yard. The minimum front yard of any lot in a qualifying subdivision, pursuant to Chapter 7 of the Subdivision Regulations shall be as follows: (Section 26.2.7 amended per Z-318 and Z-327) ~, A. Twenty (20) feet - for structures with front loading garages, with a minimum five (5) foot garage offset; Fifteen (15) feet - for structures with side loading garage, or living area forward of garage with minimum eight (8) foot offset. 26.2.8 The minimum width of side yards for schools, libraries, churches, community buildings, and other public and semi-public buildings in residential districts shall be twenty-five (25) feet, except where a side yard is adjacent to a Business, Industrial or Manufacturing District, in which case the width of that yard shall be as required in the district in which the building is located. 26.2.9 Open, unenclosed porches (not under root) or patios may extend ten (10) feet into a front yard. 26.2.10 Terraces which do not extend above the level of ground (first) floor may project into a required yard, provided these projections be a distance of at least two (2) feet from the adjacent side Lot line. 26.2.11 No side yards are required where l;lwellings are erected above commercial and industrial . .-stnicoores;-except such-side-yard-is-required-for-a-commerciaLor.industrial buikiingj!n the side of 3__ _~~ lot adjoining a residential district. --- 26.2.12 Where a garage is entered from an alley, it must be kept three (3) feet from the alley easement line. (am ended per Z-31K) 26.2.13 On comer lots the minimum buildable width of twenty-eight (28) feet for main buildings is reduced to twenty-two (22) feet for accessory buildings. In addition, no tower may be erected between a principaL building and a street, except in the required side yard in Manufacturing or Industrial Districts. (amended per Z-32U) 26.2.14 Sills, belt courses, window air-conditioning units, cornices, and ornamental features may project into a required yard a distance not to exceed twenty-four (24) inches. 26.2.15 Filling station pumps and pump islands may occupy required yards provided, however, that they are not less than thirty (30) feet from all residential lots. 26.2.16 NormaL roof overhang, open fife escapes, fireproof outside stairways and balconies opening upon fire towers, and the ordinary projections of chimneys and flues shall be permitted to project into required yards for a distance of not more than forty-eight (48) inches when so placed as to not obstrUct light and ventilation. 26.2.17 Accessory uses are permitted in the required front yard in the Business, IndustriaL and Manufacturing Districts. However, a tower must meet all setback requirements of the district in which it is erected, except that in the Industrial and Manufacturing Districts a tower may encroach into the required rear yard so long as the rear property line does not abut a Residential District. In addition, if a tower is permitted as a special exception in a Residential District, the tower must be built; Chapter 26: Additional Height, Yard, and Lot Area Regulations 26-2 as amended oer Z-318. Assuming it comes out of Committee, the Plan Commission will make its recommendation May 16th. 2-383-02 (Use Table) is slightly behind the schedule we had originally anticipated, and will be going to the Plan Commission for Public Hearing May 16th. I would now anticipate a July Council date for that item.
