Councilor Carter Pronounced the invocation.
Mayor Brainard led the Pledge-of Allegiance.
RECOGNITION Of CITY rtMPLOYEES AND OUTSTANDING CITIZENS:
Mayor Brainard presented an Outstanding CitizcnAward to I vanne Offenbacker fonccr ``Straight 2 the
Street's" initiative which raises inoney, btis ticketstand other donation-for homeIess,inclividuals in
downtown Indianapolis. She`was also recognized its a 2007 Power of Children award winner foi- this
contribution to her community.
Mayor Brainard presented an Outstanding citizen Award to Weston Luzadder.for his "Bikes 4 Kids Club"
initiative which has collected and distributed 41 bikes and helmets,to underprivileged kids. He was also
recognized as a 2007 Power'of Children award winner for this contribution to his conuiiuiuty.
APPROVAL: OF MINUTES:
Councilor Sharp made a motion to approve the Minutes from'thc December-3, 2007 Regular Meeting.
Councilor Seidensticker-scconded. There was no Council discussion. Council President Griffiths called
for the question. The Minutes were approved 5-1 (CouncilorRattermann abstained).
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
RogerKclloms, 3347 Eden Village Drive, Carmel, IN., addressed the Council,in favor of Ordinance
D-1880-07 (imposition of Weight Linirts'on Keystone -Avenue).
Angie Molt, 740 W Aurnan'Drive. Carmel, IN., addressed the Council regard€ng overlapping times and
dates of meetings lield on the same clay or evening, Mrs Molt,al'so thanked Councilors GI'aser,aud
Rattermanu for their fonr'years of service to'the City. Mrs. Molt also asked for c_lkEficatiori,ofa,claim to

COUNCIL, MAYORAL AND CLERK-TREASURER .COMMENTSLOBSER`,!ATIONS:
Councilor Rattermannasked whether the Etli cs,Board had,held,a meeting.
Council President Griffiths stated that-he had asked the City Attomey to confirm whether the Ethics
Board had met.
Councilor Sharp addressed Stephanie Gemelas' comments regarding the, Keystone,Avcnue ordinance.
Councilor Scidensticker addressed Zeff Weiss' comments•regarding.the Keystone Avenue.ordihance.
Councilor Glaser addressed comments regarding the Keystone Avenue ordinance will discussed several
issues that were discussed at the Utilities, Transportation an&Public Safety Committee regarding
Keystone Avenue.
Councilor Carter thanked Councilor Kirby for his 12 years of:service to the City. Councilor Carter also
announced that he would he officially withdrawing Ordinaice D-1'880-07 (Imposition of Weight Limits
on Keystone. Avenue) and-returmn.- the ordinance to the first Council meeting in January.
Mayor Brainard addressed comments i eg?trding the Keystone Avenue ordinance.
Clerk-Treasurer Diana L. Cordray addressed Angie?Molt'§_questiohs regarding Ainericah Structure Point
(S677,034.75) that was listed.on the claim pant out.(fund-4920 is the.Keystone Avenue Non-Reverting
fund).
ACTION ON MAYORAL VETOES:
There tiveie none.
CLAIMS:
Councilor Sharp made a motion to approve claims in the.aniount;of 53;510,042.63. Councilor Carter
seconded. There was no Council discussion. Council President Griffiths called for.the?qucstion. Claims
® were approved 6-0.

COMMITTEE REPORTS:
Councilor Sharp reported, that the Finance; Administration and Rules Committee met and,discusscd
Ordinance D-1881-67 which wasrforwarded to the Council with a 2-0 Positive recommendation.
Councilor Sharp reported that the Land Use,.Annexation and. Economic Development Committee met and
discussed Ordinance Z-512-07 and 0rdinance'Z-51'3-07 which. were,both forwarded to the Council with a
3-0 positive recommendation.
Councilor Carter reported that the Paiks, Recreation a€id,Arts Committee had not' i ict.
Councilor Glascr reported that the. Utilities; Transportation and public Safety Committee met and
discussed Ordinance D-1880-07.
OLD BUSINESS
Council President Griffiths announced the Fourth Reading of Ordinance.D-1880-07; An Ordinance of
the Common Council of the City of Carmel, Indiana; Amending Chapter 8., article 6, Sections 8-56 and
8-58, of the Carmel City Code (Imposition of Weight Limits on Keystone,Avenue). This Ordinance was
WITHDRAWN by Councilor Carter without objection.
Council President Griffiths announced-the Second Reading of Ordinance D-1881-07; An Ordinance of
the Common Council ofthe City, of.Carmel, Indiana, A1npn&1,g Ordin nee D-.1856-n7, Salaries of
Appointed Officials and Employees for 2008 (On-Call Pay FOr timployces of the Carmel Street
Department). There was brief Council discussion. Councilor Carter referred to Dave Huffman, Street
Commissioner, for clarification. Councilor Carter called for approval. Courictl' President Griffiths called
for the question. Ordinance D-1881-07was adopted 5-t (Councilor Ratterinarm opposed)-

Range Line Road Overlay Zone in the Carmel Zoning Ordinance. Councilor'Seidensiicker addressed the
Council. There was no Council discussion. Councilor Carver made a motion to approve Ordinance
Z-513-07. Councilor Sharp seconded. There was.no'Council discussion. Council` President Gril'fiths
called for the question. Ordinance Z-513-07 was adopted 6-0.

seconded. Councilor Carte presented this itennto Council. There was no Council discussion. Council
President Griffiths opened the Public Hearing at 6:50 p.m. Seeing no one who wislied to;speak, Council
President Griffiths closed the Public Hearing at 6:51 p.m There was; no Council discussion. Council
President Griffiths referted Ordiiiance.Z 5;1--07 to the Land Ilse, Annexation and Economic
Development Committee for farther review and consideration.

item into business. Councilor Glaser seconded. Councilor. Glaser:presented this item to Council and
made a motion to suspend, the rules aind notsend this item to committee and prole this evening. Councilor
Sharp seconded. There-was no. Council discussion. Council President Griffiths called for the question.

Council President Griffiths announced Resolution CC-1247-07-01; A Resoluiion of.the Common
Council of the City of Carmel, Indiana, To Set the 2008' General Fund Tax Levy and Pate. Councilor
Sharp made a motion to move this item into business: CouncilorGaiter. seconded_ Councilor Carter
presented this item to Council. There was brief Council discussion. Councilor Rattennann made a
motion to amend this ordinance to reduce the rate from'0.4329 to; .3$. Co nciloi Seidenstickcr seconded.
There was no Council discussion. COU1161 President Griffiths called for the question. The motion to
reduce file rate Failed 3-3. Councilors Glaser, Rattennann and Seidensticker voted AYE. Councilors
Carter, Griffiths and Sharp voted NAY (The Ma} grchbsenot to vote): There was no Council
discussion. Council President Griffiths called •for,the,question. Resolution CC-127-17-07-01 was adopted

Council of the City ofCa«nel, Indiana, Approding.a Transfer of Funds in_the 2007 Depattnhenfof Law
Budget (S23,050).. Councilor Sharp made a motion to-move this item into business. Councilor Glaser
seconded. Councilor Sharp referred to Doug Plancy, City Attorney, to present this item to Council. There
was brief Council discussion. Council President Griffiths called for the question.

Council President Griffiths presented awards and thanked Councilor Glaser.and Councilor Raltermann for
their four years of service to the City:
MayorBrainard thanked everyone who served this past,term for their service to the City Mayor Brainard
also annouricedahat the Inaugural Ceremony will be held,on Thursday; December 20,.2007 at 5:30 at the

Monon Center East. Supreme'Court Chief Justice Ra_ ndali Shcpard .will he administering the Oaths of
Office. Everyone is welcome to attend.,
Councilor Cartci thanked, Council President Griffiths,f&'the nice job he did the,past year as Cowicil
President.
