HomeMy WebLinkAboutBPW-01-16-08-01 Sick Pay/Buyout/Payout RESOLUTION BPW 01-16-08-01 A RESOLUTION AUTHORIZING THE BUYBACK OF EXCESS SICK.LEAVE FROM CIVILIAN EMPLOYEES OF THE CITY OF CARMEL WHEREAS, the City of Cannel grants each civilian employee a total of sixty (60) hours of sick leave per year, and allows each civilian employee to accrue and carry over from year to year up to 300 hours of sick leave; and WHEREAS, the use of such sick leave, even when necessary and approved; can have a significant and disruptive impact on City operations; and WHEREAS, the City wishes to encourage employees to use sick leave only as necessary, ahd to reward those employees who demonstrate exemplary attendance; and WHEREAS, the Carmel Common Council authorized the discretionary buyback of excess sick leave through Ordinance D-1838-06; and WHEREAS, money to find a buyback is included in the 2008 budget. NOW, THEREFORE, BE IT RESOLVED by the Carmel Board of Public Works and Safety as follows: A discretionary buyback of unused sick leave is authorized in 2008, according to the terms outlined below. All sick leave buybacks shall be based upon an employee's accrued sick leave balance as of December 31. 2007. 2.a. Any employee whose, accrued sick leave balance. on December 31, 2007; falls between 225 hours (30 days) and 300 hours (40 days) may elect to have the City buy back any or all of the sick leave in excess of 225 hours. Each eligible employee will be required to file an election form indicating the number of hours to be bought back and the number of hours to be retained. Any employee who fails to complete an election form on a timely basis shall retain all accrued sick leave up to 300 hours. 2.b. An employee's accrued sick leave in excess of 300 hours shall be bought back or forfeited. No employee may carry over more than 300 hours of sick leave from 2007 to 2008. Any employee who fails to complete an election form on a timely basis shall receive a buyback for all hours in excess of 300. 3. The rate of the 2007 buyback shall be 1:2 (1 hour of pay for each 2 hours of eligible sick leave). 4. Buyback payments shall be made by the City (either by check or direct deposit, at the discretion of the Clerk-Treasurer's office) no later than February 29, 2008. 5. The City will conduct only one sick leave buyback in 2008. An employee's decision regarding the buyback of his/her unused sick leave, as stated on his/her written election form, or, absent the timely submission of an election form, the terms of this Resolution as regards the buyback of sick leave, shall be final and binding.
