where additional measures may be required to control erosion and sedimentation. All practices recommended in this report

Dear Mr. Kutz:
This office has been notified by John B. South, District Engineer for the Hamilton County Soil and
Water Conservation District that your project known as Shelborne Park Sec. 1 is out of compliance
with the National Pollution Discharge Elimination System (NPDES) GeneralPermit Rule 327 lAC
15-5.
It is the intent of the Division to resolve non-compliance issues and avoid referring this project to
the Indiana Department of Environmental Management (IDEM) for an enforcement action.
The On-Site Evaluations for this project document that an inadequate effort has been made to
comply with the conditions and requirements of327 lAC 15-5. A copy of the most recent reports
has been enclosed. The reports clearly outline the deficiencies observed at the site and the
requirements to bring the project back into compliance.
Failure to implement and maintain appropriate erosion and sediment control measures is a serious
violation and deserves your immediate attention. It is therefore requested on or before April 30,
2003 that you adequately address the deficiencies as specified in the enclosed on-site evaluation.
Once corrective action has been taken to address the deficiencies, please notify John B. South,
SWCD Engineer.

Dear Mr. Fleming:
This letter serves to acknowledge receipt of a transmittal containing the revised plans for the Hayden Run
Subdivisfon. After reviewing the plans, the Highway Department has the following comments:
Construction Plans
1. Has the additional right of way needed for the installation of the passing blister lane acquired?
Construction plans will not be approved until the necessary right of way is acquired and the
dedication forms forwarded to the Highway Department.
2. The following note needs lo be added to the Entrance Plan sheet: A sawcut is needed to remove
the edge Hne along the north side of 13151 Street before the widening Is completed_ This will allow
for the new edge line to be place on the widening. The new edge line will need to be installed by
the developer.
3. A 24w preformed tape stop bar is needed at the entrance.
4. It appears that all other comments have been satisfactorily addressed. Therefore, the Highway
Department requests seven sets of plans for final approval. The plans should not be submitted
until all comments from the Hamilton County Surveyor's Office have been proper1yaddressed.

Dear Rodney:
I received your additional commitment letter for the Lakes at Hayden Run Subdivision on
May 21, 2002. The request for Centex Homes to commit to trees as part aflandscape
packages on individual lots (in lieu of the street trees requested to be removed from the
plan by the Hamilton Highway Department) is acceptable under certain conditions.
1. At least 1 large maturing tree is planted in the front of each these 56 lots, but
outside the right-of-way.
2. These trees should be native hardwood species, or chosen from the enclosed list
of recommended street tree species.

Item 4A. The lack of a site specific installation schedule of each measure in relation to earth disturbing and
construction activities is a concern of our office and is a requirement of Rule 5. The sequence on the plans is
generic in nature. The sequence needs to addrcss specific items on this site such as:
1. Install construction entrance.
2. Install rock horseshoe at existing road culveli.
3. Install temporary swale around the north side of pond #3 and seed it.
4. InstalI swale along east property line to a sediment trap in the southeast corner. The sediment
trap will consist of a berm built to elev. 896 with a pipe discharge with slottcd riser. The berm
\vill be located where the berm is to be installed for pond #].
5. Construct the swale along the east property line going n01ih and install a sediment basin at pond
#3 and use the existing field tile connected to a slotted riser as the outlet.
6. Start stripping topsoil from the site and installing pond #2. Provide a temporary outlet pipe for
pond #2.
These items should get the project off on the right start. Additional instructions are needed to address
storm sewer installation, inlet protection, check dams, seeding and critical area planting.
Item 4C. Some of the items mentioned in 4A above need construction details. Pipe sizes, dimensions,
elevations, grades and practice details are needed.

Dear Mr. Fleming:
This letter is in response to your Secondary Plat filing for Lakes at Hayden Run, Section 1. The
following issues must be resolved prior to signature of the plat by the director:
1. Transfer landscape plan to construction grade (verify no conflict with easements.) Provide
typical planting plan per lot. This plan will require approval by Scott Brewer, Carmel Urban
Forester, prior to approval of the secondary plat.
2. Add source of title instrument number to page one.
3. Fonvard a copy of the final review letters from the following agencies:
a. County Highway, County Surveyor, Hamilton County Soil and Water
b. Scott Brewer, DOCS Urban Forester
4. Have Mylar signed by property owner and surveyor (with R.L.S. seal) prior to signature by
director.
5. Add instrument number for survey plat to page 7.
6. Provide letter of commitment of construction of Road hnprovements per Commitment made
by owner at time of Primary Plat. We will determine the appropriate action in receiving the
improvements per the commitment within the coming months. This process is identical to
the action taken for the Hayden Run Secondary Plat.
Please submit a revised Secondary Plat with the above-mentioned changes. Once these changes have
been made and comments addressed, please produce a mylar copy for signature by this Department. Two
paper copies of the plat must be filed with the mylar prior to recording. I will return the signed mylar to
you for signature by the County Commissioners. Once recorded, our Department needs three paper
copies and a mylar of the recorded plat. Our approval of the secondary plat (signature) will be
forthcoming upon revision of the plans according to the items listed above.

Thi$ letter serves 10 acknowledge receipt of a transmittal containing the prans for the Hayden Run
Subdivision. After reViewing the plans. the Highway Department has the following comments:
Secondary Plat
1 , Please label the right of way in the cul-de-sac radii as such.
2. A 50' triangular right of way cut is needed at the intersection.
3. The non-access easement must be extended along Street A to Street D on the east side and to
Lot 1 On the west side.
4. Street names must be included.
5. Before any approvals are granted for the Secondary Plat. an Engineers Estimate broken into the
following categories will need to be submitted, alon9 with a Performance Bond or Letter of Credit
in the amount of 100% of the estimate:

Following are CTRWD comments on the agenda items effecting our sanitary sewers or service area for the March 20
TAC meeting. Please feel free to copy and distribute this email or attach it to your meeting minutes. We have also

Shelborne Park Section 1
Plans have been received by the District and reviewed by the District's engineering consultant and need to be revised
before they will be ready for submittal to IDEM for state construction permits. Building permits should NOT be issued
unless the District has issued connection permits.
Lakes at Hayden Run Section 1
Plans have been received by the District and reviewed by the District's engineering consultant and need to be revised
before they will be ready for submittal to IDEM for state construction permits. Building permits should NOT be issued
unless the District has issued connection permits.
Carmax Auto Superstores
While this project is served by Carmel Utilities, any underground work in 96th Street should be done with caution since
the District has a 16" force main under the pavement of 96th Street.
Towne Meadow Elementary
The parking lot additions do not effect any of the District's sewers. However, the School Corporation needs to be advised
that any impact on the sewers on site will necessitate inspections by the District for any repairs or modifications.
12411 Towne Road (pond)
This property is in the District's service area and sanitary sewer service is available in the Laurel Lakes subdivision west
of the property. When permits for any new home on the property are sought, the owners should contact the District about
making a sanitary sewer connection. Connection to sanitary sewers may be required by the District.
Please remind all TAC applicants to provide plans directly to the District at our main office address at:

Item 3A. & 3B. The erosion control pIall needs to encompass all areas that will be disturbed during
construction. Will any part of Sec 2 be included with this first phase of dirt work?
Item 4A. 4A. The lack of a site specific installation schedule of each measure in relation to earth disturbing
and construction activities is a c:oncern of our office and is a requirement of Rule 5. Erosion control
practices will be the most eftective if they are installed in an appropriate sequence. For assistance in
developing a schedule please contact our office or consult Section 2.3 ofthe "Indiana Handbook for Erosion
Control in Developing Areas" published by the Division of Soil Conservation, Tndiana Department of
Natural Resources The Sequence of Construction Activities is not site specific.
Item 4C. Perimeter sediment controls are needed. Consider adding temporary diversions with sediment
basinsltraps designed according to the drainage area. Sediment traps/basins will need to have size and
construction dimensions.
The maintenance paragraph (file- METES/23899) could be eliminated as this is covered in your Erosion
Control Notes. The two paragraphs about C350 don't seem to be needed.
This plan specifies 4" of topsoil for seeding. Wllen reviewing the site T will inspect for the 4" of topsoil.

This letter serves to Inform you of changes that the Highwey Department is requiring to be made to the
construction drawings for the Hayden Run, Section 1 and ShelbomePark. Section 1 Subdivisions. With
the conalr\.lction of the Shelborne Park Subdivision to occur at apptOXimateJY the same time, the Highway
Department will require that opposing left tum lanes be constructed on 131 Street at the entrance to ttle
new subdivisions. The new construction should be completed accordIng 10 the attached draWings. Centex
Homes w!ll be required to construct theneeessary pavement on the south side of 13151 street with
Shelborne ParK LLG to complete the north side of 131&\ Street. When the widening is completed, a butt
joint will need to be milled at the east and west end of the project and 1" of HMA surface placed over the
area so that new pavement markings can be installed. The two develOpers will share the Installation and
cost of the surface maberial and pavement markings. The pavement markings will need to be
thermoplastic.

. Adjustments to the widening to accommodate the new lanes- Instead of the 24' of pavement
