Dear Mr. Braun,
We are in receipt of your lelter dated November 24, 2003 concerning Shelborne Park erosion
control. We understand that noncompliance is a serious. issue and are working to rectify the
deficiencies in a timely manner. A meeting was held on :decemb~r 5, 2003 at the site with John.
South from Hamilton County Soil & Water, Kent Clayton from Drees Premi~r Homes, and John
Maren from Shelbome Park, LLC. Mr. John South indicated that overall erosion control
practices in swales, retention ponds and common areas were satisfactory. However, individual
building sites needed additional attention to erosion control. Prior to this meeting Drees Homes
had begun to implement additional erosion control measures on individual building sites. It was
requested at the meeting that John South inspect these measures and identify any performance
problems or additionalrneasures necessary to achieve compliance with NPDES Rule 5. Mr.
South identified the following items as needing additional attention:
Maintain streets free and clear of mud and debris.
Maintain inlet protection in swales and on streets.
Erosion protection must be installed at the front and rear of any disturbed lot.
The protection (Silt fence or Mulch bags) needs to be continuous to be effective.
It was agreed that greater emphasis would be placed on erosion control and that all measures
identified as. insufficient would receive immediate attention. It is our intention and the intention
of Drees premier Homes to bring Shelborne Park into compliance as quickly as possible. I will
contact John South for a reinspection of this

Dear Mr. Kessler:
This office has been notified by John B. South, District Engineer for the Hamilton.County Soil and
Water Conservation District that your project known as Shelbome Park Sec. 1 is out of compliance
with the National Pollution Discharge Elimination System (NPDES) General Permit Rule 327 lAC
15-5.
It is the intent of the Division to resolve non-compliance issues and avoid referring this project to
the Indiana Department of Environmental Management (IDEM) for an enforcement action.
The On-Site Evaluations for this project d09ument that an inadequate effort has been made to
comply with the conditions and requirements of 327 lAC 15-5. Copies of the most recent reports
have been enclosed. The reports clearly outline the deficiencies observed at the site and the
requirements to bring the project back into compliance.
Failure to implement and maintain appropriate erosion and sediment control measures is a serious
violation and deserves your immediate attention. It is therefore requested that on or before April
30, 2003 that you adequately address the deficiencies as specified in the enclosed on-site evaluation.
When corrective action has been taken to address the deficiencies, please notify John B. South,
SWCD Engineer.

Dear Tim:
This letter serves to notify you of changes. which have been made to the Construction
Plans for the Shelborne Park Subdivision. Queensland Way, which was a stub street to
the western property line, has been eliminated. Along with the elimination of the street,
storm sewer structures 816 and 815 have been eliminated. The roll curb will now be
continuous ttlrough this area, with all street storm water drainage entering structure B 14.
The stub street has been eliminated because the City of Carmel has purchased the
property to the west for relocation of the Street Department Therefore, the stub street is
not required. The" Secondary Plat will be revised to show the changes in right of way, lot
layout and affected easements. I have included a copy of the site plan and storm sewer
plan and profile sheet showing the revisions mentioned above. Please insert the new
sheets into your set of drawings.

Dear Dennis:
My comments for the above referenced plans received in May are as follows:
1. Landscape plans for the secondary plat should follow landscape plans submitted
for the primary plat by Landesign Services, including required bufferyard
plantings. Additionally, each plant should be shown on the plan specified by
species. Trees placed in the front of lots (street trees not on primary through-
ways) must be planted outside the right-of-way and shown as such on the plan.
2. There are no planting notes (specifications), plant schedule, or planting details
(graphic specifications) on the plans. These need to be included with landscape
plans, including a note that trees must be planted with root flares at grade leve].
3. There are no tree protection details on the plans. Details and placement of tree
preservation features for existing single trees and woodlands need to be
represented graphically on the plans, including tree protection fencing,
maintenance of proper drainage, and any other tree preservation details.
4. Plans must meet the perimeter buffering requirements found in Chapter 26.4 of
the Carmel Zoning Ordinances. Perimeter buffering is required even where
private Jots border the parcel.
5. Open Space common areas and buffer yard landscaping areas must be protected by
delineation and definition in the covenants and restrictions of the subdivision and
on the plat. They need to be separated from drainage and utility easements
graphically on the plat.
6. Subdivision signage must be shown graphically with the associated required
landscape plan.

Dear Mr. Fleming:
This letter is in response to your Secondary Plat filing for Shelborne Park, Section 1. The following
issues must be resolved prior to signature of the plat by the director:
1. Provide copy of approval letter of the landscape plan from Scott Brewer, Urban Forester.
2. Move Key Map to page 1.
3. Forward a copy of the final review letters from the following agencies:
a. County Highway, County Surveyor, Hamilton County Soil and Water
b. Scott Brewer, DOCS Urban Forester
4. Have Mylar signed by property owner and surveyor (with R.L.S. seal) prior to signature by
director.
5. Add instrument number for survey plat to page 4.
6. Provide estimate of construction cost of Road Improvements per Commitment made by
owner at time of Primary Plat. We will evaluate the estimate and determine the appropriate
action in receiving the improvements per the commitment.
Please submit a revised Secondary Plat with the above-mentioned changes. Once these changes have
been made and comments addressed, please produce a mylar copy for signature by this Department. Two
paper copies of the plat must be filed with the mylar prior to recording. I will return the signed mylar to
you for signature by the Colinty Commissioners. Once recorded, our Department needs three paper
copies and a mylar of the recorded plat Our approval of the secondary plat (signature) will be

Following are CTRWD comments on the agenda items effecting our sanitary sewers or service area for the March 20
TAC meeting. Please feel free to copy and distribute this email or attach it to your meeting minutes. We have also

Shelborne Park Section 1
Plans have been received by the District and reviewed by the District's engineering consultant and need to be revised
before they will be ready for submittal to IDEM for state construction permits. Building permits should NOT be issued
unless the District has issued connection permits.
Lakes at Hayden Run Section 1
Plans have been received by the District and reviewed by the District's engineering consultant and need to be revised
before they will be ready for submittal to IDEM for state construction permits. Building permits should NOT be issued
unless the District has issued connection permits.
Carmax Auto Superstores
While this project is served by Carmel Utilities, any underground work in 96th Street should be done with caution since
the District has a 16" force main under the pavement of 96th Street.
Towne Meadow Elementary
The parking lot additions do not effect any of the District's sewers. However, the School Corporation needs to be advised
that any impact on the sewers on site will necessitate inspections by the District for any repairs or modifications.
12411 Towne Road (pond)
This property is in the District's service area and sanitary sewer service is available in the Laurel Lakes subdivision west
of the property. When permits for any new home on the property are sought the owners should contact the District about
making a sanitary sewer connection. Connection to sanitary sewers may be required by the District.
Please remind all TAC applicants to provide plans directly to the District at our main office address at:
10701 N. College Avenue, Suite A, Indianapolis, IN 46280-1098.

Item 3A. & 3B. Construction limits need to be shown to clearly delineate limits of soil disturbance, a
requirement of Rule 5. The erosion control plan needs to encompass all areas that will be disturbed
during construction, Will any part of Sec 2 be included ''lith this first phase of dirt work?
Item 4A. 4A The lack of a site specific installation schedule of each measure in relation to earth disturbing
and construction activities is a concern of our office and is a requirement of Rule 5. Erosion control
practices will be the most eftective if they are installed in an appropriate sequence. For assistance in
developing a schedule please contact our office or consult Section 2.3 of the "Indiana Handbook for Erosion
Control in Developing Areas" published by the Division of Soil Conservation, Indiana Department of
Natural Resources. ldeas- After the constructlon entrance is installed, pond #1 needs to be excavated to
elev. 905 to serve as a sediment trap. Concurrently the outlet pipe to the south and a diversion swale along
the east property line needs to be installed. After these components are installed the remaining grading can
be started. A rock horseshoe dam or other restrictive measure, installed infront of outlet str # 801 would
create a better sediment trap for pond # 1. The Sequence of Construction Activities is not si te specific and
relates to another project.
Item 4C. Additjonal perimeter sediment controls are needed. Consider adding temporary diversions with
sediment basins/traps designed according to the drainage area. Sediment traps/basins will need to have
size and construction dimensions. See ideas above,
The maintenance paragraph (file- METES/23899) could be eliminated as this is covered in your Erosion
Control Notes.

Tnis letter serves to Inform you of Changes that the Highway Department is requiring to be made to the
constructIon drawings for the Hayden Run, Section 1 and Shelbome Pa~, Section 1 Subdivisions. With
the construction of the Shelborne Pari<. Sut>division to occur at apprOXimate!y the same time, the Highway
Department will require that opposing left tum lanes be constructed on 131 Street at the entrance to the
new subdivlsions. The new constnlctlon should be completed according to the attached drawlngs. Centex
Homes will be required to construct the necessary pavement on the south side of 13141 Street with
Shelbome Park LLC to complete the north side of 1311i1 Street. When the widening is completed, a butt
joint will need to be milled at the east and west end of the project and 1" of HMA surface placed over the
area so that new pavement markings can be installed. The two developers will share the installation and
cost of the surface material and pavement markings. The pavement marklngs wm need to be
thermoplastic:.
Several revisions will be required, listed below are some of the major poInts:
.. Increase the curb radius from 40' to 50'
.. Adjustments to the widening to accommodate the new 'ant~$- Instead of the 24' of pavement
needed for the decellane, approximately 19' will be needed on each side of the centerline.

The entrance will need to be widened to accommodate a right and left turn lane at the @xlt.
Additional right of way will need to be acq~ired for the installation of the decellane. The plans win
not be approved until the additional right of way has been acquired.
The improvements to 131&t Street will need to match those listed in a letter to Mr. Ed Fleming of
Stoeppelwerth end Associates, dated March 14,2002.
Relocate sanitary sewer structures 703 and 704 to prevent the sewer from encroaching into the
~ight of way.
NO road cuts will be permitted for 131'1 Street for the installation of utility or sewer IInes-
A minimum of 15' must be maintained from the right of way line to the top of bank for the lakes- If
the 15' minimum cannot be attained, a protective barrier must bl;! installed.
Remove HCHD Standard Plan U.l from the detail sheet and add standard plan C-5.
Change note A in the Site Grading Specifications from .10' tolerance to .05'.
Adjustments to Lincolnshire 80ulevard must be made to preventthe storm water from the
pavement from running of onto the adjacent site.
The median at the intersection of lincolnShire Boulevard and Beckwith Drive must match the
attached drawing for the Intersections within the 70' right of way.
Please include the folloWing note on the water distribution plan sheets "no water main valves are
to plaoed within the streets",
My offsite utilities must be placed behind the future right of way_
All offsite issues must be settled before final approval of the plans will be given_
Please note that decorative signs, sprinkler systems, trees, landscaping mounds. light poles or
other such amenities are not permitted in the right of way_
