RE: PROPERTY MAINTENANCE VIOLATION
Dear Mr. & Mrs. Miller:
This letter is being provided to inform you that it has recently been brought to the Citys
attention that the structure at 1205 Lynne Dr, a property listed under your ownership, is in
violation of Carmel City Code §6-220 the Property Maintenance Code_ The following are
the sections of code in violation:
(1) §6-222 (c) 1 General. The exterior of a structure shall be maintained in good
repair, structurally sound and sanitary so as not to pose a threat to the public
health, safety or welfare.
(2) §6-222 (c) 2 Protective treatment. All exterior surfaces, including but not
limited to, doors, door and window frames, cornices, porches, trim, balconies,
decks and fences shall be maintained in good condition. Exterior wood
surfaces, other than decay resistant woods, shall be protected from the
elements and decay by painting or other protective covering or treatment.
Peeling, flaking and chipped paint shall be eliminated and surfaces repainted.
All siding and masonry joints as well as those between the building envelope
and the perimeter of windows, doors, and skylights shall be maintained
weather resistant and water tight. All metal surfaces subject to rust or corrosion
shall be coated to inhibit such rust and corrosion. (.oxidation stains shall be
removed. All exterior surfaces shall be of uniform colors and materials to
ensure compatibility with adjoining properties.
(3) §6-222 (c) 5 Exterior walls. All exterior walls shall be free from holes, breaks,
and loose or rotting materials; and maintained weatherproof and properly
surface-coated where required to prevent deterioration.
(4) §6-222 (c) 6 Roofs and drainage. The roof and flashing shall be sound, tight
and not have defects that admit rain. Roof drainage shall be adequate to
prevent dampness or deterioration in the walls or interior portion of the
structure. Roof drains, gutters and down spouts shall be maintained in good
repair and free from obstructions. Roof Drain discharges shall be discharged
as a Legal Connection or a Legal Discharge- Inappropriate or temporary
roofing coverings including but not limited to tarps shall be deemed inadequate
protection and not uniform and as such shall be prohibited for a period
exceeding seven (7) consecutive days.

(5) §6-222 (c) 14 Openable windows. Every window, other than a fixed window,
shall be easily openable and capable of being locked and held in position by
window hardware. No special tools or knowledge shall be required to open a
window.
(6) §6-222 (e) 1 Infestation. All structures shall be kept free from insect and
rodent infestation. All structures in which insects or rodents are found shall be
promptly exterminated by approved processes that will not be injurious to
human health. After extermination, proper precautions shall be taken to
prevent re-infestation.
(7) §6-222 (e) 2 Owner. The owner of any structure shall be responsible for
extermination within the structure.
(8) §6-222 (g) 3 Interior Surfaces. Floors, walls (including windows and doors),
ceilings and other interior surfaces shall be maintained in good, clean and
sanitary condition. Peeling paint, cracked or noose plaster, decayed wood and
other defective surface conditions, including mold spores, shall be eliminated.
($) §6-222 (g) 6 Free from Dampness. In every building and all portions of the
building including, but not limited to, basements and crawl spaces shall be
maintained to prevent conditions conducive to mold formation, decay or
deterioration of the structure.
Please make the required corrections and/or repairs to the structure by March 31, 2007.

Dear Mr. and Mrs. Miller:

The Hamilton County Health Department received a complaint on the above listed property owned and/or
controlled by you. On March 1, 2007, Environmental Health Specialist Amanda Hartley investigated the
complaint. The complaint was in reference to leaks in plumbing and mold growth in the home.
Upon inspection, water stains and mold growth were visible behind the toilet in the bathroom nearest the
garage. Water stains were also visible on the opposite side of that wall in the family room. The bathroom
nearest the bedrooms had water stains and mold growth on the ceiling.
Indiana Code, IC 16-20-1-25 provides: "(a) A person shall not institute, permit, or maintain any
conditions that may transmit, generate, or promote disease. (b) A health officer, upon hearing of the
existence of such unlawful conditions within the officer's jurisdiction, shall order the abatement of those
conditions ...(c) If a person refuses or neglects to obey an order issued under this section, the attorney
representing the county, of the health jurisdiction where the offense occurs shall, upon receiving the
information from the health officer, institute proceedings in the courts for enforcement. An order may be
enforced by injunction. If the action conceming public health is a criminal offense, a law enforcement
authority with jurisdiction over the place where the offense occurred shall be notified."
Order to Comply
The Hamilton County Health Department is ordering the repair of any conditions that have led or may
lead to moisture, mold, and/or structural problems located at the above-mentioned property under IC 16-
20-1-25. The tenant expressed concern that removal and disturbance of the mold while she is living in the
home will aggravate her existing respiratory problems. She stated that she will be vacating the premises
by the end of March. Once the tenant is out of the home mold remediation may ensue. A specified time
period will not be given for the completion of the repairs. However, the home may not be rented or
leased to anv other tenants until the situation is abated and a follow up inspection has been conducted by
the Health Department. Failure to comply will result in this matter being referred to the Hamilton County
Prosecutor's Office.
