An inspection revealed that the concern appears to be valid and that the property is in violation of the Carmel City Code §6-64(c) & §6-55(a & c) as follows: (c) If any tree or shrub planted pursuant to this Section shall, in the opinion of the Board of Public Works and Safety, create a hazardous obstruction to vision which may endanger vehicular or pedestrian traffic, then said tree or shrub shall be appropriately trimmed or removed pursuant to the rules adopted by the Carmel Board of Public Works and Safety. (a) Any tree or shrub which overhangs any sidewalk, street or other public place in the City so as to impede or interfere with traffic or travel shall be trimmed by the owner of the abutting premises or of the premises on which the tree or shrub grows so as to remove the obstruction. Traffic vision shall be made to conform to the subdivision and zoning regulations of the City. (c) The City may trim or remove any tree or shrub which obstructs or endangers traffic or travel on any street, sidewalk or other public place, or any sub-surface utility provide for public use. Please be advised, if the above referenced violation is not corrected by April 15, 2007, the City of Carmel will bring this matter into compliance. You, as property owner(s) will be liable for and billed for the cost of correcting the violation and all administrative costs. The obstructive trees needs to be completely removed or trimmed of all obstructing limbs pursuant to §4-4.2 of the Carmel Street Tree Regulations. I have contacted several tree moving companies and get the same advice. Each have indicated that due to the dry weather they do not recommend that the trees be moved until August or they will die. Since the trees are very valuable I am requesting an extension until that time frame for their removal. I really do not want to lose the trees and hope that you will grant the extension.
