SUPPLEMENTAL DECLARATION OF
COVENANTS AND RESTRICTIONS OF
HAVERSTICK PROPERTY OWNERSHIP
THIS SUPPLEMENTAL DECLARATION made this 10th day of _May_. 2002,
by Centex Homes, a Nevada general partnership as successor in interest to Centex Homes
Company, an Indiana general partnership ("Declarant"),

WHEREAS, the following facts are true:
A. Declarant is the sole owner of the fee simple title to the following described
real estate located in Hamilton County, Indiana, to-wit:
See legal description attached hereto made a part hereof and marked Exhibit A
(hereinafter referred to as "Settler's Ridge, Section Two B").
B. On June 23, 1995, Declarant executed a Declaration of Covenants and
Restrictions of Haverstick Property Ownership which was recorded in the Office of the
Recorder of Hamilton County, Indiana on June 23, 1995, as Instrument No. 9540437 as
amended by Supplemental Declarations, recorded on December 30, 1996, January 15,
1997, May 9, 1997, October 7, 1997, July 2, 1998, October 14, 1998 July 6, 1999,
OctoberS, 1999, October 14,1999, August 16, 2000, November 1, 2000, June 5,2001
and July 23, 2001, as Instrument Nos. 9609654253, 9709701433, 9709718060,
9709742618, 9709742620, 9809835941, 98581000, 9858098, 9940002, 9958105,
9960198, 200000040348, 200000054645, 200000054648, 200100032801 and
200100045182, respectively; and a First Amendment recorded on May 9, 1997 as
Instrument No. 9709718061 ,a Second Amendment recorded on August 1, 2000, as
Instrument No. 200000037449, and a Third Amendment recorded August 1, 2000, as
Instrument No. 200000037450 (all of which were recorded in the Office of the Recorder of
Hamilton County, Indiana (the "Declaration"). The Declaration is incorporated herein by
reference and all of the terms and definitions as described therein are hereby adopted and
shall have the same meaning in this Supplemental Declaration.
C. Settler's Ridge Section Two B is part of the Real Estate described in
paragraph A of the recitals of the Declaration. Paragraph 24 of the Declaration provides
that all or part of the Real Estate may be annexed to Haverstick Property Ownership,
incorporated into the Declaration and the Owners thereof become members of Haverstick
Property Ownership.in accordance with the conditions in paragraph 24 of the Declaration
and the filing of the Supplemental Declaration by Declarant. All conditions relating to the
annexation of Settler=s Ridge Section Two B to the Tract of Haverstick Property Ownership
have been met, and Declarant, by execution of this Supplemental Declaration, hereby
incorporates Settlerl s Ridge Section Two B into Haverstick Property Ownership.

NOW, THEREFORE, Declarant makes this Supplemental Declaration as follows:
1. Declaration. Declarant hereby expressly declares that Settler's Ridge
Section Two B and all appurtenant easements, Common Area, Limited Common Area,
Lots, improvements and property of every kind and nature whatsoever, real, personal and
mixed, located thereon is hereby annexed to and becomes a part of Haverstick Property
Ownership as if such originally had been included in the Declaration, and shall hereafter
be held, transferred, sold conveyed and occupied subject to the covenants, restrictions and
provisions of the Declaration, and the rules and regulations as adopted by the Board of
Directors, as each may be amended from time to time. Settler's Ridge Section Two B
hereafter and for all purposes shall be included in the definition of "Tract" as defined in
paragraph 1 (t) of the Declaration.
2. Description of Lots. There shall be thirteen (13) Lots, Numbered 41 through
53 in Settler's Ridge Section Two B as shown on the Supplemental Plat for Settler's Ridge
Section Two B. Haverstick Property Ownership or the Tract now has Four Hundred Ninety-
Six (496) Lots.
3. Square Footage. All Dwelling Units located on Lots in Settler's Ridge Section
Two B shall have a minimum of 1,300 square feet of finished living area (exclusive of
garages, carports, basements and porches).
4. Acceptance and Ratification. The acceptance of a deed of conveyance or
the act of occupancy of a Lot and/or Dwelling Unit shall constitute an agreement that the
provisions of this Supplemental Declaration, the Declaration and any rules and regulations
adopted pursuant thereto, as each may be amended from time to time, are accepted and
ratified by each Owner, tenant and occupant, and all such provisions shall be covenants
running with the land and shall bind any person having at any time any interest or estate
in a Lot and/or Dwelling Unit or the Property as if those provisions were recited and
stipulated at length in each and every deed, conveyance, mortgage or lease thereof.
5. Supplemental Plat. The Supplemental Plat for Settler's Ridge Section
Two B prepared by Stoeppelwerth & Associates, Inc., certified by Dennis D. Olmstead, a
registered land surveyor under the date of _May 8_,2002, setting forth the layout, location,
identification and dimension of the Lots identified in this Supplemental Declaration is
incorporated into the Declaration, added to the plans filed with the Declaration, and has
been filed in the Office of the Recorder of Hamilton County, Indiana, as of
as Instrument No.
6. To the extent that there are any inconsistencies in the terms and conditions
of this Supplemental Declaration, the Declaration and any recorded Plat, the terms of such
recorded Plat shall control.
7. Except to the extent modified or amended herein, all terms and conditions
of the Declaration remain in full force and effect.

We have reviewed the revised plans and comment letter dated March 14,2002. We will approve the
drawings for this section, contingent upon the following additional revisions being made to the drawings:
Sheet 3 - Swale Detail behind lots 21 and 22
. Label the swales as existing and as proposed.
., Also label the proposed swale with general dimensions as you did wiUl swale behind lots 41 thru
47.
Sheet 8 - Sanitary Profile
o Remove flowable fill from cradle detail. The standard for the City of Carmel is granular.
Sheet 12 - Construction Details
. Regarding the typical swale detail, revise the wording on the blanket detail to read, "Ends of
blanket to be turned down and buried at top of swale banks."
When these revisions have been made, send us a minimmn of five-sets (or the nwnber requested) of
certified drawings. Please send these drawings prior to the Developer paying the appropriate Water and
Sanitary Sewer Availability Fees, as I must get the drawings signed by the City Engineer and the Director,
Cannel Utilities.

RE: Settler's Ridge at Haverstick, Section 2B, Secondary Plat
Dear Mr. Fleming:
This letter is in response to your Secondary Plat filing for Settler's Ridge at Haverstick, Section
2B. The following issues must be resolved prior to signature of the plat by the director:
1. Move the Key Map to Sheet 1 and correct, site not in correct spot.
2. Remove Common Lot Address from the Legend.
3. Remove Director's signature block from Sheet 1.
4. Add a Source of Title Instrument # to Sheet 1.
5. The monuments and markers should be as required under Section 8.2 of the SCO.
a. Add markers at all points where lot lines intersect curves (all lines along streets),
as required under sea 8.2.4.
6. Change Primary Docket Number to 11-94 PP.
7. Please remove Billy Walker fyom the Board of Public Works signature block; it may
be left blank for now. Please contact us prior to submittal for this information. A
new member has yet to be assigned.
8. Have Mylar signed by property owner and surveyor (with R.L.S. seal) prior to
signature by Director.
9. Forward a copy of the final review I approval letters from the following agencies:
a. City of Carmel Engineering Department
b. Hamilton County Surveyor
c. Soil and Water Conservation District
Please submit a revised Secondary Plat with the above-mentioned changes. Once these changes
have been made and conunents addressed, please produce a mylar copy for signature by this
Department. Two paper copies of the plat must be filed with the mylar prior to recording. Upon
signature by the Director, I will take the plat to Dick Hill for placement on the next available

II. Not enough as-built elevations have been indicated. Show rear drainage direction and

ADDITIONAL COMMENTS
a) \Vhy is the temporary stone turnaround (sheet 3 and sheet 6) being proposed? This has
not been utilized before. Please shmv justification why a temporary barricade would not
be appropriate at this location as is indicated at the other stub street location.
b) How is the curb-line drainage protected or diverted at the north terminus of the
North/South stub street (sheet 3)7 Please show how this drainage is to be captured and
directed to an appropriate outlet.
c) Show the existing storm sewer on the Settler's Ridge, Section 1 detail on sheet 3. Show
additional details on the swale (elevations, slopes, etc.).
d) The TIC elevation for structure #975 (storm table, sheet 3) will have to be lowered later
in order to handle the rear yard swales ofthe future section.
e) As repeatedly requested on previous submittals for this subdivision, please include the
stoml sewer design to provide for alignment of the tops of all pipes at structure locations
so that the drop is within the structure.
f) It is difficult to read the small print on the Typical SSD Lateral to Individual Lots Along
Streets (sheet 12). Please increase the font size.

PRIOR FIELD APPROVAL FROM A DESIGNA TED REPRESENTATIVE OF THE CITY OF
CARMEL IN ADDITION TO SUPPLEMENTAL APPROVAL BY THE DESIGN ENGINEER. AN
EXPLANATION OF ANY SUCH DEVIATION SHALL BE INCLUDED AS A REQUIREMENT ON
AS-BUJLT/RECOKD DRAWINGS SUBMITTED FOR REL'EASE OF PERFORMANCE

7. The lot numbers on the overall Settler's Ridge Watershed Map in the Drainage Calcs binder do not
agree with Section 28 plans, or with previous sections site plan submittals. Existing and proposed lots
need to be labeled correctly and consistently across all section submittals.
8. The stonn sewers must discharge to a defined drainage course or retention/detention facility.
9. A defined drainage swa1e should be established from end section structure #971 to the normal pool
elevation of the lake, in order to prevent serious erosion problems. TIlis swale should be protected
with a pennanent erosion control lining since it will have a slope of approximately 10% (structure
#971 Inv. = 760.0'/N.P. of pond = 744.9'/distance == 150').
10. Provide storm sewer pipe size, length, material and slope inforrnatlon for all storm pipes shown on Site
Development Plan (Sheet 3). Include arrows showing the direction of surface flow for existing and
proposed future sections.
II. Please provide as-built/record elevations for existing adjacent sections. Additionally, include all
relevant information about existing or future rear/side yards draining to the current proposed storm
stmctures, either by inclusion of as-built elevations, future proposed elevations or directional arrows.
12. Drainage calculations should summarize flows for tIlis section of the development and reference the
overall drainage plan.
13. Identify the discharge area for stonn structure #971. It is a common area, is it an easement, etc.?
OTHER COMMENTS
14. Existing adjacent sections should include lot nwnbers, street names, etc. and include existing pavement
elevations where new pavement is to match into existing.
15. Is there a future road/connection at tile nortll end? What temporary controls for road block, signage,
drainage and erosion control will be provided?
16. Based upon the plat provided, the Availability (acreage) Fee for this project would be:

My apologies, I have one additional item to add to the TAC Agenda for the
16th of January. Seeing the agenda is now only a total of three items it is
not a record for the fewest items.
The additional item is the Townhomes at Hazel Dell (formerly Hazel Dell
Pond). Same site, different plan, somewhat a work in progress.
It is within the City limits so Steve Broermann with Highway and Steve Cash
still don't have to worry.
