An inspection revealed that the concern appears to be valid and that the property is in violation of the CarmeUClay Zoning Ordinance as it relates to the number of pets allowed in a residential home. The following are the 2 definitions related to this situation: KENNEL, COMMERCIAL-- Any Lot on which four (4) or more dogs, or small animals, at least four months of age are kept. KENNEL, RESIDENTIAL- Any Lot on which three (3) or less dogs, or small animals, at least four months of age are kept. As you can see by these definitions, having more than 3 animals in your home is considered a "commercial kennel" and, therefore, a violation of the zoning ordinance. You do have an option of filing for a variance to seek approval to legally establish the number of animals at your home. Either that or the permanent removal of all animals in excess of three would be in compliance with the ordinance. Please bring this property into compliance with the Carmel/Clay Zoning Ordinance by April 30, 2007. Failure to resolve the violation(s) by the specified deadline will result in further enforcement action by the City of Carmel.
