This property is currently zoned residentially (R3), which does not permit for business operations to be run from the property. The only standards that permit for a business to be run from a residential property are the Home Occupation standards (§25.18) of the Carmel Zoning Ordinance. The nature of the home occupation standards is to allow a home business to operate with NO visible evidence or impact upon the property's residential character. Activities such as large commercial vehicles, storage of equipment and materials as well as the daily gathering of employees violates these regulations. There is a certain impracticality of attempting to run a construction business in a residential neighborhood in a way that would not impact the residential character, much less have no visible exterior evidence of the business when the business requires storage of machinery, vehicles, and materials, regardless of whether or not they are stored indoors or outdoors. Inspections have been performed of the property and the violations are the parking and/or storage of commercial vehicles, commercials trailers, heavy equipment and business related materials on residentially zoned property. All of these are violations of the Ordinance and must be corrected by the removal of the vehicles, equipment and the materials from the property by May 6, 2007. Since you have failed to reach compliance in this matter I am giving you a five-day extension to achieve compliance before compliance measures escalate. If the property is not in compliance by July 31, 2007 1 will issue a citation (equal to $280) to you, everyday, until the property is in compliance. This means the removal of all equipment and materials (including all rubbish) off of the property or stored as to not violate the Horne Occupation Standards. I have included a copy of the ordinance concerning Home Occupation(s) in order to assist you in clarifying and rectifying this matter.
