Martin 2109 Renegade Ct. Carmel, IN 46032 RE: CITY CODE VIOLATION -DECK WITHOUT A PERMIT Dear Mr. Martin: This letter is being provided to inform you that the City has recently received a complaint regarding a deck located at 2109 Renegade Ct., in the City of Carmel, a property listed under your ownership. Carmel City Code prohibits this type of activity without first obtaining a permit from the Division of Building and Code Services of the City of Carmel. Carmel City Codes § 7-9 states: (a) It shall be unlawful for any person or entity to construct, alter, repair, remove or demolish any building or structure, or to commence construction or the alteration of real estate, without first filing a written application with the Director and obtaining an improvement location permit or other appropriate permit regarding same, unless the submission of same is expressly excused by applicable law. The deck which has been constructed and is over 30 inches off the ground is required to have a permit to legally establish it. Additionally, the deck is encroaching into the 30 foot dedicated drainage and utility easement. No structure is allowed to compromise a dedicated easement and must be located a minimum of 3 feet away from such easement. The compliances choices available to you are as follows: 1) remove the entire deck, 2) remove all portions of the deck to ensure that it is 3 feet away from the easement, 3) petition the Board of Zoning Appeals to allow the deck to remain. If this variance is approved a "Non-enforcement Agreement on Individual Tracts" will be required to be obtained from the Hamilton County Surveyor's Office. Please bring your property into compliance by May 31, 2007. Failure to comply by the date listed will result in further enforcement action.
