It is a violation of Carmel City Code §6-222 which states: ILLEGAL DISCHARGE. An open discharge of a Private Drainage System or Private (cutlet, an Illicit Connection or Illicit Discharge per Carmel City Code Section §6-1$0 through §6--209, as amended; or is closer than 25-feet from the property or easement line and/or onto a non-absorbent surface or causes, creates or results in or represent the potential to cause, create or result in a Detriment. The sump pump/downspout outlet discharges onto the property line which is in violation of Carmel City Code. Please relocate the outlet so that it gains compliance with the code by June 16, 2007. Cityof Cannel DEPARTMENT OF COMMUNITY SERVICES /NDIA0 Division of Building and Code Enforcement June 15, 2007 Bruce & Lisa Ackerman 12411 Springbrooke Run Carmel, IN 46033 Dear Mr. & Mrs. Ackerman: This letter is being provided to inform you that the enforcement file for a possible Illegal Discharge violation has been closed. The information supplied to this office from a concerned citizen has been found unsubstantiated by further information provided by the both of you during my site inspection on June 12, 2007. During my inspection I observed the drainage and sump pump outlets near the rear of your property and decided that they do not pose a hazard nor a substantial violation of current code. As I explained during our conversation your swimming pool and drainage system was established prior to the adoption of the Carmel City Code that prohibits this. The fact that the outlets are directed towards and located in the drainage easement is an acceptable drainage method. I thank you for your cooperation, and especially your honesty, in this situation. I also observed the 2 drainage outlets appearing on your neighbor's property to the east and I can easily conclude that it is a violation of current code, but that, just like yours, it predates the code and poses no hazard and outlets into the drainage easement just as yours does. The only concerns that remain are the wooden fence and the landscaping wall that have been located in this easement and require a "Consent to Encroach" to be legally established. As I informed you during my visit I have already contacted Gary Duncan, Assistant City Engineer, to start the application for obtaining the "Consent to Encroach" and I would stay in touch with him to discuss this remedy and conclude this process. Mr. Duncan can be reached at 571-2441 or at gduncan(a)carmel.in.gov. I would like to extend my apology to you if my previous correspondence caused you any undue hardship or concem. As of the date of this letter the enforcement file has been officially closed and a copy of this letter has been placed within the file.
