You indicated that you would send a letter to the property owner notifyfng him(her of the violation of a city code. About eight weeks later when nothing had been done, l wrote to you again. You indicated that you would again contact the property owner and that if the violation was not corrected the city would trim the tree and bill the property owner. An inspection revealed that the concern appears to be valid and that the property is in violation of the Carmel City Ordinance D-1121 §6-55(a-c) as follows: (a) Any tree or shrub which overhangs any sidewalk, street or other public place in the City so as to impede or interfere with traffic or travel shall be trimmed by the owner of the abutting premises or of the premises on which the tree or shrub grows so as to remove the obstruction. Traffic vision shall be made to conform to the subdivision and zoning regulations of the City_ (b) Any tree or limb of a tree which is likely to fall on or across any street, sidewalk or other public place shall be removed by the owner of the premises on which such tree stands. (c) The City may trim or remove any tree or shrub which obstructs or endangers traffic or travel on any street, sidewalk or other public place, or any sub-surface utility provide for public use. Please be advised, if the above referenced violation is not corrected by July 13, 2007, the City of Carmel will bring this matter into compliance. You, as property owner(s) will be liable for and billed for the cost of correcting the violation and all administrative costs. If you have any questions please contact me at 571-2476.
