She is our permit inspector and would be the one to deal with non-enforcement, encroachment, and violation issues. she will check into the situation and will get back with you and the property owner. I would bez we do not have a non-enforcement and will not likely support one since this appears to be a dry detention area on a residential lot. We changed our standards after this development and no longer allow dry detention on residential lots because cf cases exactly like this. Looking at the plot plan, it is a detention area that they are currently constructL.g their fence in. Carmel Engineering tells me that it is County regulated.. I went ahead and posted a stop work on the ob -until we had a chance to talk to you about the situation. Do we have a non-enforcement agreeement on this property? The detention area in which you are attempting to build your fence is regulated by the Hamilton County Surveyor's Office. The purpose of such areas are to provide, maintain, and ensure proper drainage and water run-off for the coltective of homes in the area. Therefore, these areas are protected from any sort of building, including the construction of fencing. Section 25.02.08 of the City of Carmel Zoning Ordinance states: "No fence shall be constructed within the approved subdivision retention/detention drainage facility easement." After discussion with the Carmel Engineering Department, the Hamilton County Surveyor's Office, and review of the Plat of Hunters Creek South, section 2, it has been determined that no Non-Enforcement permit has ever been issued from the Hamilton County Surveyor's Office- Previous property owner, Diana Holloway, submitted for a Non-Enforcement permit for a swimming pool installation at 957 Nevelle Lane on August 14, 2006. That permit was denied. County Officials in the Hamilton County Surveyor's office inform me that it is not likely that they would support a petition for a Non-Enforcement permit to construct a fence in this regulated detention area. Your current options are to remove the existing posts from the detention area and discontinue any construction in this area or to petition to obtain a Non-Enforcement permit from Hamilton County for the construction of a fence in the detention area. The Stop Work Order will remain in effect until the posts are completely removed and the disturbed areas are restored or until you have received a valid Non- Enforcement permit from Hamilton County. Please take the necessary steps to bring this property into compliance with the CarmeVClay Zoning Ordinance to prevent further enforcement action. This Stop Work Order is for constructing posts and attempting to construct a fence in a drainage detention area. The reason for the Stop Work Order is the Hamilton County Surveyor's Office has jurisdiction in this detention area and the area was designed to hold or store water for the Subdivision. A permit would not be issued for this location because of this. The previous property owner submitted a permit request to construct a swimming pool at this location and was denied in August of 2006. Please remove the posts that have been placed to restore the area to its original conditions.
