RE: CITY CODE VIOLATION - PUBLIC NUISANCE
Dear Mr. Smith and Ms. Lingval-Smith:
This letter is being provided to inform you that there is some concern regarding the condition of the
property at 5348 Underwood Ct., in the City of Carmel, a property listed under your ownership. A simple
site visit was performed on July 10, 2007 in which the following Carmel City Code violation was
documented:
§6.75 Public Nuisances Prohibited. No person shall erect, contrive, cause,
continue, maintain or permit to exist any public nuisance within the City.
§6-76 Public Nuisances Defined. A public nNsance is a thing, act, occupation,
condition or use of property which shall continue for such length of lime as to:
(a) Substantially annoy, injure or endanger the comfort, health, repose or
safety of the public; or
(b) In any way render the public insecure in life or in the use of property; or
(d) Unlawfully and substantially interfere with, obstructor tend to obstructor
render dangerous for passage any street, alley, highway, navigable body of water
or other public way; or
(e) Is injurious to health, or indecent, or offensive to the senses, or an
obstruction to the full use of property, so as essentially to interfere with the
comfortable enjoyment of life or property.
§6-77 Public Health Nuisances. The following acts, remissions, places, conditions
and things are specifically declared to be public health nuisances, but shall not be
construed to exclude other health nuisances coming within the definition of §6-76_
(c) Accumulations of decayed animal or vegetable matter, trash, rubbish, rotting
lumber, bedding, packing material, junk vehicles, scrap metal or any material in which flies,
mosquitoes, disease-carrying insects, rats or other vermin may breed, or may be a fire hazard;
The issue of the apiaries (or beehives) on the property has been brought to the attention of this
department. This violation must be permanently abated. Failure to abate this violation could result in
further enforcement action, which could include the issuance of a Complaint and Summons to appear in
Carmel City Court. Please see that action is taken to bring this site into compliance by August 10, 2007
to avoid further enforcement action. This will be the final request for compliance. If you have any
