Cl*t of Carmel DEPARTMENT OF COM%4UNITY SERVICES [)Ivision of Building and Code Services VIA CERTIFIED MAIL September 28, 2007 GOV11 David S. & Patricia Huggins 803 Meadow Crescent Carmel, IN 46032 RE: CARMEL CITY CODE VIOLATION - MULTI-USE PATH OBSTRUCTION Dear Mr. & Mrs. Huggins: This letter is being provided to inform you that it has recently been brought to the City's attention that at 803 Meadow Crescent, a property listed under your ownership, that you have obstructed the Right of Way by placing basketball goal in street. It is a violation of Carmel City Code § 8-67, §6-222 & §6.227 which states: § 8-67 -- No person shall maintain or construct any steps, stairs, building, fence, platform, trapdoor, cellar door, area, or other encroachment or obstruction upon, in or under any street, alley or public ground without a permit the Board of Public Works and Safety. §6-227 (a) 6 -- No person shall alter or modify existing City of Carmel, public or other Improvements within easements or rights-of-way at any time without proper approvals. §6-222 (b) 16 -- Easements and Rights-of-Way i. Unless otherwise stipulated by other codes or ordinances, a permit from the Board of Public Works and Safety pursuant to Carmel City Code Section §8-67, or an executed Consent-to-Encroach approved by the City and properly recorded in the Hamilton County Recorders Office: 1. The City and the Easement Holder reserves the right to remove any Improvement in the easement or right-of-way at the expense of the Owner or the Responsible Party. 2. No damages will be awarded to the Owner or the Responsible Party if damage occurs to an Improvement within an easement or right-of-way resulting from City or Easement Holder activity. Please remove the basketball goal you have obstructed the Right of Way with or employees of the City of Carmel will remove it and you will be liable for all expenses incurred in the removal process. This must be completed by October 8, 2007.
