RE: ZONING ORDINANCE VIOLATION
Dear Sir or Madam:
This letter is being provided to inform you that our department has recently received some
concerns regarding 302 Pintail Court in the City of Carmel, a property listed under your
ownership. The concern cited that the property's fence at the rear of the property
exceeded the permitted fence height and was constructed within an easement as per the
Carmel/Clay Zoning Ordinance §25.02. The following regulations apply to all fences in
residential zoning districts:
25.02 Fences.
25.02.01 On residentially used or zoned lots of less than two acres, fences located
within any required front yard shall not exceed forty-two (42) inches in
height, as measured from the topmost point thereof to the ground adjacent
to the fence. At least twenty-five percent (25%) of its area shall be open as
viewed on any line perpendicular to the vertical plane of the fence. Such
open spaces must be reasonably dispersed throughout the entire area of
the fence, except where solid stone or brick walls are permitted.
25.02.02 Residential fences located within any required side or rear yard shall not
exceed six (6) feet in height, as measured from the topmost point thereof to
the ground adjacent to the fence.
25.02.03 Residential fences not located within any required yard but within the
buildable area shall not exceed nine (9) feet in height, as measured from
the topmost point thereof to the ground adjacent to the fence.
25.02.04 Any fence placed upon an erected earth berm or masonry wall must
govern its height as measured to the ground adjacent to said earth
berm or wall.
25.02.05 Open wire mesh fences surrounding tennis courts may be erected to a
height of sixteen (16) feet, if such fences shall only enclose a regulation
court area and standard apron areas.
25.02.06 Fences enclosing an institution, a public park, schools, and commercial
or industrial property may consist of an open mesh fence not to exceed a
height of ten (10) feet.

25.02.07 No sign, fence, wall, shrub or other obstruction to vision shall exist in the
area designated as the vision clearance area of corner lots.
25.02.08 No fence shall be constructed within the approved subdivision
rate ntionldetention drainage facility easement.
25.02.09 No fence shall be constructed within the twenty-foot (20') mandatory
planting strip associated with frontage places and hammerheads.
25.02.10 Swimming Pools. In districts where a private swimming pool is permitted
as an Accessory Use, the fencing for such pool must comply with both this
Section 25.02 and the standards applicable in the district. Whenever the
Board grants Special Use approval to a private recreational development or
facility that includes a swimming pool, the Board shall require appropriate
fencing and shall also require the applicant to make a Commitment that
necessary lifeguard protection will be provided at all times when the pool is
open for use.
This department performed an initial site inspection of the subject property and
documented that the fence at the rear of the property was in violation of §25.02.04 and
§25.02.08 which regulates the fence in the rear yard shall only be six (6) feet in height.
There are two resolutions to this violation. The first is to simply reduce the fence height to
six (6) feet. The second option is to apply for a Variance of this standard to the Board of
Zoning Appeals and a Consent to Encroach from Carmel Engineering. If you choose to
apply for a Variance, you will need to contact Christine Barton-Holmes at (317) 571-2417
and she will be able to answer any questions and further discuss this process. The
Carmel Engineering office can be reached at (317) 571-2444. Please either modify the
fence or apply for a Variance and Consent to Encroach by October 12, 2007.

I have a few questions about a fence that was put up on 302 Pintail Court Carmel IN 46032.
According to 25.02.01 It states the fence shouldn't be over 42" high in the front. I went and measured the
fence on this lot and it is six feet or higher in the front.. It also states at least 25% of the fence must be open
as viewed on any line perpendicular to the vertical plane of the fence.
Does this mean the fence shouldn't be one continuous structure and have breaks?
Should this have been allowed, or should the owner have had to ask for a variance? Is so. did they?
Can you tell me if the fence is in the drainage easement? How would I find out.
Is there an ordinance about keeping fences up, stained once they are up?
