number(s) of the Carmel/Clay Zoning Ordinance that applies and/or creates the need for this request).
Applicant is seeking a variance from 9 26.04.04 to allow for the installation of the Landscape buffering required
under Chapter 26 to be located within a county regulated drain easement, subject to the approval of the Hamilton

County Drainage Board and/or the Department of Engineering of the City of Carmel.
8) State reasons supporting the Development Standards Variance: (Additionally, complete the attached question
sheet entitled "Findings of Fact-Development Standards Variance").
The primary plat for Westwood Estates provided for a ten (10) landscape buffer adjacent to the thirty (30) drainage
easement for Lots 17-21. However, the lots when built do not have sufficient depth to allow for the landscape
buffer outside the drainage easement. The easement is a "closed" drain so the landscaping will not interfere with
the draining of the lots or the subdivision.

FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
This variance will allow a landscape buffer to be installed as required under the Ordinance. The drainaqe
easement uses a "closed" drain, which will not be adverselv affected by the landscape plantings.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
The addition of the landscape buffer will enhance the transition from the subdivision to the adioining property to the
south.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
There is not enouqh depth to the building Lots to allow for the landscape buffer without the variance.

IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance
