The need for the zoning waiver arises from some condition peculiar to the property and such

The strict application of terms of the ordinance to the property will constitute an unusual and

Drainage

The project site consists of cultivated row crops in good condition with moderate crop residue
and a mixture of woods and farmstead dwellings. The majority ofstoTInwater drains to the west
via overland flow into the Long Branch Regulated Drain. The rest ofthe site drains east under
Shelbourne Road and into the J. W. Brendle Regulated Drain.
The proposed detention system is intended to attenuate j:JOst-developed flows for the Wellsprings
of West Clay developnient. The detention pond is designed to detain the entire 14.87-acre tract
and discharge through an outlet control structure towards the Long Branch Regulated Drain via
overland flow.
Originally, there is part ofthe tract (4.2 acres) that is part of the J. W. Brendle Regulated Drain.
During proposed conditions, the 4.2 acres will be removed from tbe Brendle Drain and
introducted into the Long Branch Drain via our proposed detention pond.
As proposed, the system will attenuate developed condition flows for the entire project based on a
unit allowable release rate of 0.1 cfs/acre and 03 efs/acre for the 10 year and 1 DO year design
staTIns, respectively. These release rates are applied to existing onsite basin A (7.2 acres). Below
is a list of allowable release rates for the post-developed site.

4002 Developer Contribution: Developer funding of association shortfall.
The first month of each quarter is based on 90% of the homeowners paying their
dues. Pro-rated dues, which are in the second and third months of each quarter,
