Petitioner: yv'\ r..,L -;;1\1 1/ r ..:r ~ L l--L FINDINGS OF FACT. DEVELOPMENTAL STANDARDS VARIANCE 1. The approval of this variance will not be injurious to the public health. safety, morals and general welfare of the community because: All above 1 isten i terns wi 1 1 hI" ;mprmrprl hpC"'l1l':;:E> ):l "",.."ro1" "-l1n-...1"T.rro building will be renovated into a neighborhood attraction. 2. The strict application' of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: Without the proposed variance, the building will be unusable due to the lack of on-site parking. With that in mind~it will not be economically feasible to renovate this building without the proposed variance. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Developmental Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. S:\carmelclaylanduseregs\checklist\devstandapp Revised 10/17/2000 Page B of a - Developmental StAndards Variance Application Statement of Use Variance Docket Number: V-8-02 Petitioner: Mink Investments, LLC This property is currently zoned B-L Section 27.5 titled" Amount of Parking Spaces Required" states the requirement for on-site parking and the designated number of parking spaces based on specific uses. The building on this property occupies the entire lot. It would be impossible to meet any parking requirements on-site because no parking is available on-site. On either side of the building is a city parking lot. Thus, the petitioner is requesting a variance from the requirement for on-site parking. Statement of Supoort Docket Number: V-8-02 Petitioner: Mink Investments, LLC The building is currently being used for storage. Ifthe variance is granted, a major renovation of the building will occur. Our plans are to restore the building to its original condition. Our desire is to attract a restaurant to the location upon completion of the renovation. This is only possible with the variance. Without the variance, it will not be economically feasible to renovate the property. We believe the entire downtown district will benefit greatly from this project. Property values will be enhanced by renovating a run-down building and the downtown area will become a much more vibrant area with the addition of a quality restaurant. We stand ready to begin. this project within 60 days of variance approval. - - I!T AI/I.. SvJ R~"Be ~;~c. J ( 3 e. > <I' :-\ RD4.!. l l'llr ,- p.Je tJl,j L.. ~ ,.g" ~." .J"Od )..
