1 am writing to request an extension to our Amenity Center approval for Long Branch
Estates per Docket No SU -10-02 and Docket No. V -11-02. Our plans are to begin
constmctiol1 yet this Spring of 2003. I will be filling for my building pem1it within the
flext couple of 1110nths with construction to stmi post permit. Our goal is to make the
amenity center yet usable for this season. I would like a one time six (6) month granted
as per our Letter of Grant dated March 26, 2002. Please contact me wHh any questions or

While preparing Commitments for Long Branch Estates, Section 1, Block C (SU-10-02), I find that the property owner
listed on the application form is Northside Investments, LLC. The Hamilton County database lists the primary taxpayer as
Bennett Family Farm, Inc. cia Farmcraft Service, Inc. However, the Letter of Commitment received by the Department is
on Platinum Properties letterhead, and is signed by Paul F. Rioux, the President of Platinum Properties. Please clarify the
relationship among these four entities immediately. The Department needs specific information regarding who is
authorized to make binding Commitments on behalf of this petition. Please be aware that the Board of Zoning Appeals
may not be able to make a final decision on this matter until this question is resolved.

Statement of Commitments:
1. A lifeguard will be present at the Swimming Pool during all hours when the
Swimming Pool is open to the residents of the subdivision known as Long Branch
Estates.
2. The Applicant understands that the representations made above will survive the
ownership of the property. The Applicant will make the requirements above an
integral part of any agreement to sell the property.
Binding on Heirs, Successors and Assigns. These Commitments are binding on the owner ofthe
Real Estate, each subsequent owner of the real estate, and each person acquiring interest in the real
estate, unless modified or terminated by the governmental authority authorized to modify.
Recording. The undersigned agrees to record these Commitments in the Office of me Recorder of

While preparing Commitments for Long Branch Estates, Section 1, Block C (SU-10-02), I find that the property owner
listed on the application form is Northside Investments, LLC. The Hamilton County database lists the primary taxpayer as
Bennett Family Farm, Inc. cia Farmcraft Service, Inc However, the Letter of Commitment received by the Department is
on Platinum Properties letterhead, and is signed by Paul F. Rioux, the President of Platinum Properties. Please clarify the
relationship among these four entities immediately. The Department needs specific information regarding who is
authorized to make binding Commitments on behalf of this petition. Please be aware that the Board of Zoning Appeals
may not be able to make a final decision on this matter until this question is resolved.

Regarding the addition of Long Branch Subdivision, Amenity Area to tomorrow's TAC agenda, we offer the following
comments. These will also be posted on our website linked under the "Construction" page.
The plans need to have the District's sanitary sewer specifications incorporatEld instead of the City of Carmel's; the
details on Insight's plans are not CTRWD spec and are not acceptable. These specs can be downloaded from the
"Construction" page of the District's website. In addition, if a lateral was not installed with the main line sewer for this
property, a connection to a manhole may be required, but the plans are unclear as to whether a lateral was installed with
the main line by the developer. Please have Insight or the developer contact us for clarification of District requirements
and permit information. Building permits should not be issued without the District's connection permit.
Please let me know if there are any questions. Thanks again for the opportunity to provide comments.

Our office has reviewed the Special Use Amendment and Developmental Standards
Variance petitions filed by Insight Engineering on behalf of Northside Investments, LLC, for Long
Branch Estates, Section i, Block C, at 3834 Castle Rock Drive. The following are comments that
need to be addressed:

.. Please remember to provide fully filled out Findings-of-Fact sheets for the Special Use
Amendment and each Developmental Standards Variance the night of the meeting for the

Board. The Findings-of-Fact and Ballot Sheet must be collated.

Recreational uses. The "D" bufferyard width is fifteen (15) feet. The parking for this
project appears to encroach into this bufferyard by five feet on both the east and west.
o If there is, any lighting associated with this project, it will need to be submitted at this time
for review.
. The parking lot needs to be fully curbed. There are sections of the lot that do not appear to
have curbs indicated on the plans.
. For purposes of sign permitting and review, this use win be considered under Section
25.7.02-7: Special Use & Use Variance Signs of the Sign Ordinance.
. Detailed comments on the Landscape Plan will be provided separately by the City's Urban
Forester.
