Per your written request dated March 25, 2003, and pursuant to Sections 21.02.07: Time
Limit and 30.5.5: Time Limit of the Carmel/Clay Zoning Ordinance, I am granting a one-time, six-
month extension of the approval of Docket Nos. SU-IO-02 and V-ll-02. The aforementioned
petitions were approved Monday, March 25, 2002; therefore, with this extension, the approvals
now expire Thursday, September 25,2003.

At the meeting held Monday, March 25, 2002, the Carmel/Clay Board of Zoning Appeals
took the following action regarding the Special Use and Developmental Standards Variance
petitions filed by you on behalf of Northside llvestments, LLC, for property located at 3834 Castle
Rock Drive on Block C of Section 1 in the Long Branch Estates Subdivision:
APPROVED with Conditions: Docket No. SU~10~02, a petItIOn to establish a Private
Recreational Facility on 6.211::1: acres. The Board voted three (3) in favor, zero (0) opposed,
thereby approving the petition with the following Conditions:
1. That a revised Landscape Plan be submitted showing appropriate
bufferyard plantings along the east, west and south property lines.
2. That the Lifeguarding Conunitment be rendered in recordable form.

Development or Facility; 1: Commercial Swimming Pool; (A): Minimum Area of the Zoning
Ordinance in order to establish an 880-square-foot Commercial Swinuning Pool on site. The Board
voted three (3) in favor, zero (0) opposed, thereby approving the petition.
WITHDRAWN by Petitioner: Docket No. V-12-02, a petition to vary Section 26.4: Perimeter
Buffering Requirements; 5(c) ofth~ Zoning Ordinance in order to establish a zero-foot (0') south
perimeter bufferyard on site. The Petitioner Withdrew the petition prior to the Board's making a
Motion. Per Article VIII, Section 6, of the Board's Rules of Procedure, a resubmittal oftrus petition
may not appear on an agenda of the Board before June 25, 2002.
When applying for an Improvement L.ocation Permit for this site, please include a
copy of tbis letter with your application materials in order to assist the Department's
review.
Please be advised that per Sea.tibn 21.2.7: Time Limit of the Zoning Ordinance, the
aforementioned Special Use approval is valid for one (1) year. By that time, either continuous
construction of site improvements must be underway, or a written request for a one-time, six-
month extension of the approval must have been received and approval granted by thi s
Department prior to the expiration date. The expiration date of this approval is Tuesday, March
25,2003.
Please be advised that per Section 30.5.5: Time Limit of the Zoning Ordinance, the
aforementioned Developmental Standards Variance approval is valid for one (1) year. By that
time, either continuous construction of site improvements must be underway, or a written request
for a one-time, six-month extension of the approval must have been received and approval
granted by this Department prior to the expiration date. The expiration date of this approval is
Tuesday, March 25, 2003.
Attached is a draft of the Lifeguard Commitment for this site. I will forward an
electronic copy of the same to Paul Rioux at PRioux@platinum-properties.com for completion.
Once the necessary information has been completed, return two (2) copies of the signed,
notarized, and recorded copy to the Department. This must be completed before a building
permit is issued for this site.

No. 200200009200 in Plat Cabinet 2, Slide 745 in the Office of the Recorder of
Hamilton County, Indiana
Statement of Commitments:
1. A lifeguard will be present at the Swimming Pool during all hours when the Swimming
Pool is open to the residents of the subdivision known as Long Branch Estates.
2. The Applicant understands that the representations made above will survive the
ownership of the property. The Applicant will make the requirements above an
integral part of any agreement to sell the property.
Binding on Heirs, Successors and Assigns. These Commitments are binding on the owner ofthe
Real Estate, each subsequent ownerofthe real estate, and each person acquiring interest in the real
estate, unless modified or terminated by the governmental authority authorized to modify.
Recording. The undersigned agrees to record these Commitments in the Office of the Recorder of
Hamilton County, Indiana, upon granting of the approval of the project.
Enforcement. These Commitments may be enforced by the CarmeJJClay Board of Zoning Appeals
and/or the City of Carmel, Indiana.
