I have reviewed your letters of March 18~ 2002 and April 4, 2002 as well as the minutes of the TAC meeting held on March 20, 2002. In those documents, the Department is taking the position that the Stouts must dedicate a seventy foot half right-of-way along Towne Road and commit to dedicate a right-of-way for the future collector road to connect West 126th Street to Meeting House Road, once the location of the collector is determined. The Department's position is prhnarily based upon Section 2.9 of the CanneVClay Zoning Ordinance which provides: "All ptoj ects under the jurisdiction of this ordinance shall confonn with the terms of the Thoroughfare Placin regard to public dedication of proper rights~of-way." In our view, the Stout's proposed pond enlargement does "confann" 'With the Thoroughfare Plan because their drainage plan does not interfere with the antiCipated location of the future collector road and because the "proper rights-of-wayH (or this road have not yet been detennin~ for any dedication. Your Apri14~ 2002 letter also mentions Section 21.3(23) as a basis for this position, but that section merely sets forth the factors the Board '~shaU give consideration td~ and bY itself does not make publi-c dedication of rights-of-way a requirement any more th81l Sections 21.3 (19) and (20) require fencmg and exterior lighting~ by way of example. Most Significantly, however, the Stouts. position is that the required dedications are an unconstitutional condition upon the approval of their; petition and constitute an uncompensated taking of their property. Clearly, if the Department simply required the Stouts to dedicate portions of their property, rather than conditioning their special use petition on such a dedication) a taking would occur. The Departn:;J,ent'sauthorityto exact such a condition is circumscribed by the Fifth and Fourteenth Amendments to the United Stated Constitution. Unless the condition upon the Stouts' requested pond enlargement has a reasonable rela1ionship to the purpose ofthe ordinance, the condition "is not a valid regulation ofland but 'an out-and-outplao. of extortion. m Nollan v. It is our contention that the Stouts' drainage improvements and pond enlargement project have absolutely no relationship to the benefit to the City of Cannel from the requested dedications. The project will have no impact upon traflic in any way. 'W'hile the Department's interpretation of the ordinance mayor may not be constitutional as applied to a proposed residential community or a proposed eonnnercial development, either of which may have an impaet upon tramc patterns and traffic volume that the Thoroughfare Plan is meant to address, it certainly does not pass constitutional muster as applied to an individual homeowneJ:' desiring to improve the drainage on his or her lot. On behalf of Mr. and Mrs, Stout, I ask that the Department reconsider its position in this matter and make a determination that the required dedications are not related to the impact of the Stouts' project and are not applicable in this instance. Mail Dear Mr. & Mrs, Stout: With respect to the information submitted by you to the Department on Monday, April 1, 2002, the Department offers the following comments: . :Mr. Cash's comments regarding what he would do on his own property are entirely irrelevant. No member of T AC has at any time questioned the appropriateness of the proposed improvement. . The right-of-way requirements in this area are clear. You have been officially informed in writing ofthose requirements by this Department. · You were presented with the Carmel/Clay Thoroughfare Plan, which has been approved both by the Carmel/Clay Plan Commission and the Cannel Common Council (most recently amended per Resolution No. CC-10-01-01-08). The Carmel/Clay Thoroughfare Plan is the authoritative document setting forth the right-of-way requirements for the City of Carmel and Clay TO\Vl1ship, Indiana. Per Section 2.9: Compliance with Thoroughfare Plan right-of-way dedication is a requirement, not a suggestion. · Laurence Lillig has not tied the approval of the Artificial Pond to the dedication of rights- of-way; the Zoning Ordinance does that in both the aforementioned Section 2.9 and in Section 21.3(23), which makes such dedication one of the bases of the Board's review for a Special Use application.. . TAC review often reveals unanticipated issues similar to the right-of-way question you now face with your petition, That it did not surface during a preliminary review in no way excuses the requirement. · :Mr. Dobosiewicz did respond regarding the relationship in the Ordinance between the rights-of-way and the Special Use application. He explained that it was the application for the Special Use that triggered the requirement, and that, if you do not wish to meet the requirement, you need not pursue the petition further. Make the D~dication of appropriate rights-of-way as required by the Zoning Ordinance and proceed to Public Hearing on April 22, 2002. 2. File De;.:elopmental Standards Variance Petitions for Section 2.9: Compliance with Thoroughfare Plan and Section 21.3(23); and proceed to Public Hearing on all three petitions at the Tuesday, May 28, 2002, meeting of the Board of Zoning Appeals. If you choose this route, please be sure to file the Developmental Standards Variance petitions no later than 5:00 p.m., Friday, April 12, 2002. 3. Withdraw the Special Use petition and forego the expansion of the pond. It - "i'" Steve Cash stated that what the Stouts are planning as it regards drain tile and retention pond is exactly what he would do it it were his property. Steve Cash and John South have both visited the property and have made their suggestions accordingly. Laurence Lillig referenced his letter of March 18, 2002. The Stouts had not received the letter and were therefore given a copy at the T AC meeting. The Stouts received the letter in the mail on Saturday, March 23,2002. The minutes reflect a "required" 70-foot half right of way for Towne Road frontage. It should be noted that there was not and has not been any official conformation given the Stouts that there are any "required" rights of way along Towne Road other than the 25 foot existing right of way that appeared on the survey they had done priQr to purchase of the property. The Stouts were presented with a "Thoroughfare Plan" that suggests a "collector" road connecting West 126m Street and the Meeting House Road in the Village of West Clay. The Stouts were not provided with any official confirmation that such plan is or will be approved by an appropriate body of government. The Stouts have also received no notice of such a suggestion save the 2/18/02 Laurence Lillig letter. Laurence Lillig has tied the approval of the pond drainage plan to the dedication of rights of way as a part of the special use approval process. The site is located at 12411 Towne Road. The site is zoned S-1lResidential - Estate. Filed by Shelley L. Stout. Mike Stout presented the case. He introduced his wife, Shelley, and Torn Spiker who will excavate the pond. They are building on a property at Towne Road. The parcel is lovv compared to surrounding sites The existing, small pond is silted in with old drain tiles running to it. The petitioners want to enlarge the pond and, as a result, better handle drainage from the surrounding properties. Steve Cash has no objections to their project but has a couple of recommendations. The Stout parcel receives a lot of run off from the property to the west. Me Cash suggested doing something with that area as it will probably be very wet most of the time. There is a drain tile that goes up the southern boundary and to the pond. That area along the property l.in,e can be improved by replacing the tile and installing a catch basin. Or, the land could be swaled a little better. Currently, there is a tile at the bottom part of the site. The petitioner does not plan to fill in the low area; an open channel will be utilized. Steve Cash suggested installing a new pipe to the property line with a catch basin. The surface flow will go to the catch basin. Or, it can be improved by cutting a v-line swale to that point. It is good that nothing is being blocked from the north. The depth of the pond will be 8.5 feet. Typically, the Hamilton County Surveyor's Office recommends a safety ledge for ponds. Steve Cash can provide the details for construction. Mr. Spiker plans a 3 to ] slope. A 5 to I slope was suggested by Mr. Cash. A catch basin would help gather the collection of no-till debris from farm fields and prevent it from going to the ditch. Me Stout is considering laterals to the pond. Steve Cash recommends tying any field tile into the new pipe. John South stated an erosion control plan is needed only if more than five acres are disturbed. The pond needs seeding and bank specifications on the plan. He suggested some type ofrigid pipe to discharge the tiles into the pond. A steel CJ\.1P with animal guard should be placed on the end of the existing drain tiles. Mr. South recommended a rock check dam within the channel. It would be a temporary facility made out of riprap to serve as a sediment barrier. It will help catch some of the sediment flow while the pond is being dug. Mrs. Stout inquired about bank seeding and stabilization. John South suggested tall fescue though it is not wildlife friendly It is not good around horses. A blue grass/rye grass mix is an excellent material. Steve Broermann had no comments. No permits are required. Scott Brewer did not receive plans. They can be discouraged by seeding with native pond vegetation instead of short grass. Gary Hoyt has no problem or concerns. Laurence Lillig referenced his letter of March 18tl1. Mr. and Mrs. Stout should contact Steve Broermann of the Hamilton County Highway Department regarding dedication of the required 70-foot half right of way for the Towne Road frontage. The Thoroughfare Plan will connect the West 126th Street collector road to Meeting House Road in the Village of West Clay. The alignment will go thru the property and continue north and west. The City does not know exactly where it will be located. Carmel is suggesting a commitment to dedicate once the design is accomplished. This dedication of both rights of way is tied to the special use approval process. Eventually, Towne Road will be similar to Hazel Dell Parkway. The Village of WestClay will construct their segment of the road The Stouts will not be asked to construct the road. Mr. Stout believes dedication will use two to three acres of their property. Mr Lillig responded that it depends on where the alignment of the road occurs. Approval of the special use for the pond is tied to dedication of right of way. Carmel approval is not required for drainage work to the existing pond. Plans indicate a pole barn will be relocated to Tract 2. Accessory buildings are not allowed on tracts without a principle building. A new deed must be prepared combining Tracts I and 2. Mr. Stout understands approval is not required if they decide to just install drain tile throughout the entire property. To receive permission to construct the pond, they must agree to right of way dedication along the frontage and some corner which is yet to be determined. ]'v1r. Lillig stated right of way dedication is one of the requirements for special use approval. Jon Dobosiewicz added it is his obligation to not allow improvements that inhibit construction as identified in the Thoroughfare Plan. Adding drainage to the property that discharges into the existing swale or drain does not require approval. Mr. Dobosiewicz stated he was not suggesting the Stouts sidestep the requirements. If they do not want to dedicate right of way pursuant to the process of special use approval, they may drain their property to today's location and not construct or modify the pond. If Mr. Stout wishes to just de-silt the pond, plans would be required for the Department to determine if approval is necessary. If they excavate the pond eight feet deeper, approval would be required. :Mr. Lillig said it might be a depth issue in regard to the expansion of the use. With respect to a pond, volume is a primary factor in determining expansion, and increased depth yields increased volume. It would be a factor. Installation of drain tiles would not require approval by the Department. Mr. Dobosiewicz stated the Stout's charge is to return with plans for Carmel's review. If they modify the pond's volume, approval is required. Steve Cash stated an outlet request is needed if the Stouts run a tile into the ditch. Mr. Dobosiewicz clarified that he is not asking Mr. and Mrs. Stout to provide access for two to three acres of their property. Rather, through their request for special use approval to constmct the pond, there are certain requirements ofthe Ordinance. If the Stouts elect to pursue another route, the Department has endeavored to explain what they can and cannot do. The pond, which can be viewed on the aerial location map attached, is irregularly shaped and drains to the county ditch east of our property. We plan to maintain current water flows from adjacent properties and clean up the open channel, which serves as an overflow to that ditch. Further, as shown on the survey map, we plan to increase the size of the pond and maintain or repair existing drain tiles. We have hired Tom Spiker, of Tom Spiker Excavating, to excavate the pond, determine the condition of the current drain tiles and make the necessary repairs, if needed. Guy East, our builder, John South of Hamilton County Soil & Water Conservation, Tom Spiker and I recently held a meeting at the property to access the existing conditions of the site and talked through the construction of the proposed pond. This included discussion of the water level of the pond, bank heights and overflow to the county ditch via an open channel. OUf property elevation is low in comparison to surrounding properties and we must properly direct the water flows to our pond and subsequently to the county ditch and the retaining ponds beyond in the Village of West Clay.
