I briefly discussed the light problem with Doug. After looking at my neighbors lights last night, it appears to me that they have installed commercil grade lights in our neighborhood. When the leaves fall, these lights will light up my backyard. I feel like I am living next to a retail center. Hopefully you guys can come up with something that will protect my privacy and rights. I can't sleep at night because the above neighbor has his bright motion sensor flood lights pointed directly at my house. Even after I spent $1100 for heavy duty curtains the motion sensor light still shines through to my bedrooom. He also installed commercial grade lights in his driveway. I talked to him about these lights, but was not successful. I have shown restraint up to this point , such as having my own light show installed and directed at his backyard and bedroom. This isn't what living in Carmel should be about. Kevin Brennan stated that if we were already annexed by Carmel, that he would utilize the Public Nuisance section of the Carmel City Code to require that the neighbor fix the light problem After my last meeting with Mike Hollibaugh, I was given hope that something would be done. Mike, I am hoping that you can send a letter out to the Melrose's as soon as possible. I am reaching out to Mayor Brainard , because he and I have something in common in that both our daughters will be performing in the upcoming Nutcracker. I also voted for the mayor and really like the direction that our city is going in. I even purchased two Ryland townhomes on City Center Drive for investment purposes when they were first built. Gentlemen what my neighbors are doing is wrong and they are violating my families right to privacy, quiet and repose in Carmel. I used the words quiet and repose, because those are the words that your city attorney gave me when we were on the Carmel Government building elevator together. Your attorney introduced himself to me when I was in route to see Mike. I couldn't help myself, but talk to him about the lights. Gentlemen, a letter from the City of Carmel to my neighbors would most likely fix the problem. I need your help and thank you for your consideration. P ..I ry Message Pagel of 3 DeVore, Laura B From: DeVore, Laura B Sent: Thursday, September 27, 2007 4:20 PM To: Hollibaugh, Mike P Subject: RE: 11124 St. Andrews Lane, Carmel, In. 46032-Angie & Andy Melrose Mike: Let me update you after my conversation with Mr. Scheibert: I let Mr. Scheibert know that Mr. and Mrs. Melrose were willing to exceed the City's expectations in terms of making accommodations to have the lights lowered by an electrician and to point the lights directly at the ground, in addition to lowering the bulb wattage. He expressed concem relating to the motion sensor portion of the light. I informed him that the City could provide him no service in eliminating the motion portion of the light as it was not an Ordinance violation. I informed him of the ordinance violations on his property at which point he wanted to know if the City was going to do anything about the "Commercial Lighting" on the trees. I informed him that the City would call the Melrose's and request that the bulb in the Tree light closest to his property be reduced, but that the City could not guarantee him any sort of resolution. (That light is at least 20 feet from the comer of his property and at least 80 feet from the comer of his home.) I told Mr. Scheibert that the City wanted to be fair with him on bringing resolution to the Ordinance violations on his property and I requested that we agree on an appropriate date when resolution could be achieved. We have established that date and I have also called the Melroses to request their additional accommodation on the other lighting matter he brought up today. I anticipate that I will speak to Mr. Scheibert at least one more time to follow up, but I do not anticipate that you will receive any additional correspondence from him regarding this issue. If you do, however, I would be glad to address that as well. Please let me know if you have any additional comments or concerns. They have agreed to lower the bulb wattage and have scheduled to have an electrician come to the site to relocate the light down a little bit and 9/28/2007 Message Page 2 of 3 point the lights to the ground. They indicated to me that they have significant trouble with large pests (ie: raccoons, squirrels, and chipmunks) because of the heavily wooded lot and the stacks of firewood that sit on the neighboring property. This is the reason that they maintain the motion sensor light. I plan to contact Mr. Scheibert to notify him of his neighbor's steps towards compliance and to inform him that his extensive wood pilings and fencing are in violation of Sections 25.02.08 and 25.09 of the Carmel Clay Zoning ordinance within a few days.
